ATTY/ORD.0004/CC ORD SB 79 - HISTORIC RESOURCE EXCLUSION <br />REV: 07-02-26 MI <br />Page 1 of 7 <br />ORDINANCE NO. _____ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF REDWOOD CITY <br />IDENTIFYING SITES FOR TEMPORARY EXCLUSION FROM SENATE <br />BILL 79 APPLICABILITY AND AMENDING THE REDWOOD CITY <br />ZONING MAP TO INDICATE THE LOCATION OF SUCH SITES <br /> <br />WHEREAS, Senate Bill (SB) 79, the Abundant and Affordable Homes Near Transit <br />Act (Government Code Section 65912.155 et seq.) became effective on July 1, 2026, and <br />establishes statewide residential density and height standards for sites located within <br />one-half mile of qualifying transit-oriented development stops; and <br /> <br />WHEREAS, Redwood City has one qualifying transit-oriented development stop <br />at the Redwood City Caltrain Station as defined in Government Code Section <br />65912.156(p); and <br /> <br />WHEREAS, SB 79 authorizes local jurisdictions to temporarily exclude certain <br />sites from areas subject to SB 79 through the adoption of a local ordinance which is <br />effective through the year following the adoption of the seventh revision of the City’s <br />Housing Element, pursuant to Government Code Section 65912.161(b) and subject to <br />review and approval by the California Department of Housing and Community <br />Development (HCD); and <br /> <br />WHEREAS, SB 79 permits the temporary exclusion of sites from SB 79 <br />applicability designated on a local historic register as of January 1, 2025, pursuant to <br />Government Code Section 65912.161(b)(1)(F); and <br /> <br />WHEREAS, the City has analyzed sites within one-half mile of the Redwood City <br />Caltrain Station and identified those that qualify for temporary exclusion under SB 79, as <br />set forth in Exhibit A attached hereto and incorporated herein by reference; and <br /> <br />WHEREAS, on June 16, 2026, the Planning Commission held a duly noticed public <br />hearing, in accordance with all applicable requirements of the Redwood City Zoning <br />Code, to consider the temporary exclusion of sites subject to SB 79 until one year after <br />the adoption of the seventh revision of the City’s Housing Element as shown in Exhibit A; <br />and <br /> <br />WHEREAS, on June 23, 2026, a public notice of these amendments was <br />published and circulated in the San Mateo Daily Journal; and <br /> <br />WHEREAS, on July 13, 2026, the City Council held a duly noticed public hearing, <br />in accordance with all applicable requirements of the Redwood City Zoning Code, to <br />consider the temporary exclusion of sites subject to SB 79 until one year after the adoption <br />of the seventh revision of the City’s Housing Element as shown in Exhibit B; and <br /> <br />8.A. - Page 35 of 97 <br />253
