ATTY/ORD.0004/CC ORD SB 79 - HISTORIC RESOURCE EXCLUSION <br />REV: 07-02-26 MI <br />Page 2 of 7 <br />WHEREAS, after the public hearing, the City Council has considered the whole of <br />the record for the project, including relevant testimony, and determined that it desires to <br />adopt the Zoning Map Amendments as shown in Exhibit B. <br /> <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. Recitals. The recitals set forth above are true and correct and are <br />hereby incorporated herein by this reference as if fully set forth in their entirety. <br /> <br />Section 2. Findings. In accordance with all requirements of Article 49 of the <br />Zoning Code, the City Council hereby finds that the proposed Zoning Map Amendments <br />are in the public interest, are consistent with the Redwood City General Plan, and <br />increase the quality of the provisions of the Zoning Code in guiding and regulating the <br />future development, growth, and evolution of Redwood City. <br /> <br />Section 3. Compliance with CEQA. The proposed Zoning Code Amendments <br />have been reviewed with respect to applicability of the California Environmental Quality <br />Act (“CEQA”) and the State CEQA Guidelines (California Code of Regulations, Title 14, <br />Sections 15000 et seq.). Pursuant to Government Code Section 65912.160(c)(2), an <br />ordinance enacted to make a local zoning code consistent with SB 79 shall not be <br />considered a project under CEQA, and therefore no environmental analysis is needed. <br /> <br />Section 4. Adoption. The City Council of the City of Redwood City hereby adopts <br />an Ordinance to amend the Zoning Map as provided in Exhibit “B” attached hereto and <br />incorporated by reference. <br /> <br />Section 5. Severability. If any section, subsection, sentence, clause or phrase of <br />this ordinance is for any reason held by a court of competent jurisdiction to be invalid, <br />such a decision shall not affect the validity of the remaining portions of this ordinance. <br />The City Council of the City of Redwood City hereby declares that it would have passed <br />this ordinance and each section or subsection, sentence, clause and phrase thereof, <br />irrespective of the fact that any one or more sections, subsections, sentences, clauses or <br />phrases be declared invalid. <br /> <br />Section 6. Publication. The City Clerk shall publish this Ordinance in accordance <br />with applicable law. <br /> <br />Section 7. Effective Date and Expiration. This ordinance shall go into effect thirty <br />(30) days from adoption and shall be in effect until the effective date of the City's seventh <br />revision of its Housing Element unless state law otherwise supersedes this expiration. <br /> <br />Section 8. Codification. Exhibit B to this Ordinance shall replace pages 1 and 2 <br />of the City's Zoning Map and no other sections of this Ordinance shall be codified. <br /> <br />* * * <br />8.A. - Page 36 of 97 <br />254
