Public utility distribution lines and poles and underground facilities for local distribution of gas, <br />water, electricity, and telephone service shall be allowed in all districts without obtaining a Use <br />Permit therefor. <br />B. Public utility storage and maintenance yards and offices shall be permitted only in the districts <br />wherein such uses and activities are specifically permitted by this article. <br />C. Public utilities substations, pumping stations, equipment buildings, and similar facilities whose <br />locations are dictated by the physical factors of the service they perform may be permitted in any <br />district provided that the public utility proposing such an installation in a district where such is not <br />otherwise permitted can demonstrate conclusively to the Zoning Administrator that a necessary <br />public service cannot reasonably otherwise be provided without locating such facility where <br />proposed, and provided further that a Use Permit be obtained in each case. <br />D. All proposed gas, water, telephone, and electric transmission lines and facilities, whose main <br />purpose is the transmission of bulk quantities of these services, rather than local distribution to <br />consumers, shall be permitted in all districts provided that a Use Permit be obtained in each case; <br />and provided, further, that no Use Permit granted pursuant to this subsection shall be effective until <br />reviewed and approved by the Council Zoning Administrator, subject to such conditions and <br />modifications deemed appropriate by the Council Zoning Administrator. <br />E. Notwithstanding the provisions of Article 42, corporations and public service agencies having powers <br />of eminent domain may apply for Use Permits in advance of acquisition of property rights. Even <br />though construction has not begun, such permits shall not automatically terminate unless, at the <br />end of ten (10) years, the permittee has acquired less than fifty percent (50%) of the length of the <br />rights-of-way or area of property concerned in the permit granted. <br /> <br />31.10 - Reserved. Residential Structures. <br />A. Demolition or Reduction in Dwelling Units. Projects that demolish existing residential dwellings <br />must create at least as many dwellings as demolished consistent with Government Code Section <br />66300 (Housing Crisis Act of 2019). <br />B. Non-Residential Use.
