1 <br />ATTACHMENT D: Zoning Code and Municipal Amendments <br />Detailed Description of Clerical and Other Minor Code Maintenance Amendments <br />Zoning Code <br />1.Definitions – Article 2 of the Zoning Code is where most technical or specialized terms used in <br />the rest of the Code are defined. The proposed amendments in Article 2 are intended to: <br />a. Revise existing definitions with minor clarifications to help make them more precise <br />and/or easier to understand (e.g. “Urban Lot Split”, “Mobile Home”); <br />b. Create definitions for terms that are used in other parts of the Code but not currently <br />defined (e.g. “Food Preparation”, “Bicycle Parking”, “Building Official”, “City Tax <br />Administrator”, “Community Development Director”, “Fire Marshal”, “Ministerial <br />Review”, “Manufactured Homes” , “Recreational Vehicles”,); <br />c. Remove definitions for terms that are no longer used in the Code (e.g. “Retail Sales, <br />Second Hand Store” and “Watercourse, Protected”) <br />2.Land Use Updates - The proposed amendments would update permitted and conditionally <br />permitted uses, remove outdated land uses, and add a new land use to allow catering and <br />similar uses in industrial districts. The proposed amendments are intended to update, add, or <br />delete the following uses: <br />a.Health/Fitness Club - Currently, health/fitness uses are permitted by-right for small clubs <br />or conditionally permitted for large clubs in some zoning districts. A small club is defined <br />as 2,500 sq. ft. or less and large club is defined as 2,500 sq. ft. or greater. Despite the <br />established definition, the Zoning Code applies the small/large threshold inconsistently <br />across different zoning districts, and uses 2,500 sq. ft. in some districts and 5,000 sq. ft. <br />in other districts. The proposed amendment would increase the small threshold to 5,000 <br />sq. ft. or less and large to 5,000 sq. ft. or greater. No additional changes are proposed to <br />whether these uses are permitted or conditionally permitted within zoning districts. The <br />proposed amendment would also update the land use definition to include physical <br />therapy. <br />b.Medical Office - Currently, medical office is a conditionally permitted use in areas where <br />administrative or professional offices are allowed by right. Conditional use permits <br />analyze the impacts, including parking, that a proposed land use imposes to a site and <br />adjacent properties. Medical offices are operated completely indoors on an appointment <br />basis and generally do not cause significant noise or odor impacts, and are more <br />frequently evaluated for parking related impacts, such as increased traffic and parking <br />spillover into adjacent properties. On January 1, 2023, State law was updated (AB 2097) <br />to prohibit jurisdictions from mandating minimum parking requirements within a half- <br />mile of major transit, in this case Redwood City Caltrain Station. Because minimum <br />parking requirements cannot be enforced, the purpose of a conditional use permit and a <br />public hearing to evaluate the impacts of medical offices are no longer essential. The <br />proposed amendments would permit medical office by right within half mile of major <br />transit, where State law does not allow cities to require minimum parking. Also, in the <br />Professional Office (PO) district, the proposed amendments would change medical offices <br />and accessory pharmacies from a conditional use to permitted by-right. <br />8.B. - Page 201 of 212 <br />516
