2 <br />c.Retail Sales, Second Hand Store, is also known as a thrift store. Updates to State law bar <br />jurisdictions from prohibiting thrift stores and instead allow them by right in areas that <br />general retail is allowed. Currently the zoning ordinance conditionally permits “Retail <br />Sales, Second Hand Store”, which is inconsistent with State law. The proposed <br />amendment would delete the “Retail Sales, Second Hand Store” land use term and <br />incorporate thrift retail as allowable as part of the “Retail, General” land use. <br />d.Research and Development (Laboratory Type) vs (Office Type) clarification - The Zoning <br />Ordinance contains three terms for Research and Development: <br />1. “Research and Development” - A general defined term, but not a land use. <br />2. “Research and Development, Laboratory Type” - A land use that devotes a <br />substantial amount of floor space to laboratories, product research and <br />development, or prototype manufacturing. <br />3. “Research and Development, Office Type” - A land use that occurs in a primarily <br />office setting related to computer software development, computer research, <br />artificial intelligence, and automation with minimal space devoted to <br />laboratories, testing, and manufacturing. <br />The proposed amendments would clarify that “Research and Development” provides an <br />overall definition of what Research and Development entails while also clarifying that <br />“Research and Development, Laboratory Type” and “Research and Development, Office <br />Type” are land uses that may or may not be allowed in specific zoning districts, with <br />complementary clean up language to the land use tables in the MUT and MUW zoning <br />districts to specify whether the permitted Research and Development land use listed in <br />the zoning district is related to “Laboratory Type” or “Office Type”. Additionally the <br />proposed amendments updated the Research and Development description and land use <br />types to capture emerging technologies to encourage the growth and retention of <br />innovative business in the city and to keep pace with changes in the Research and <br />Development industry. <br />3.Removal of Outdated/Obsolete Content – The proposed amendments would delete or update <br />sections of the code that have fallen out of use; these include the following: <br />a. Efforts to dissolve the Subdivision Committee were initiated as part of the Subdivision <br />Ordinance update (Chapter 30 of Municipal Code) adopted by City Council on October 14, <br />2024, but amendments were limited to changes to the Municipal Code and did not amend <br />the Zoning Ordinance. The proposed amendments would remove all remaining <br />references to the Subdivision Committee in the Zoning Ordinance (Articles 40.4, 40.7, <br />41.7, and 41.8). <br />b. Update Article 41.4.B.4 to be consistent with 2024 amendments to Article 48.4 (Floor <br />Area Ratio for Single-Family Homes), which clarifies ambiguous language in the code <br />regarding when an Architectural Permit is required to go to a public hearing. <br />c. Update or delete cross-references within the Zoning Code that are either incorrect or <br />obsolete, which are incorrect or no longer exist <br />8.B. - Page 202 of 212 <br />517
