5 <br />relocate creek setback reference to Section 32.3, which is where supplementary setback <br />provisions are located. <br />e.Live/Work (Article 31.4) – Article 31.4 establishes live/work standards that regulates <br />live/work units. Live/work units are a separate land use designation from general <br />residential, as it combines work space with incidental residential occupancy within a <br />single unit. The live/work regulations have specific standards related to the size of the <br />residential and non-residential portions of the unit, number of employees, prohibited <br />uses, etc. Currently, the Zoning Code requires an update to support proper enforcement <br />of the code and to prevent abuse of live/work provisions. The proposed amendments <br />would clarify both residential and nonresidential land uses within a live/work unit must <br />be permitted within their underlying zoning district in order to qualify as a live/work <br />unit. <br />f.Move sections from Article 31 (Special Uses) to Article 32 (Supplementary Provisions). <br />Article 31 is intended to provide regulations for unique uses, which cannot otherwise be <br />properly provided in the base zoning district regulations. Article 32 is a more <br />appropriate location in the code to provide clarifications, exceptions, and supplemental <br />information for common uses allowed in other sections in the code. The following <br />proposed amendments would move sections from Article 31 to Article 32: <br />‘Building Intensity Limits for Residential Care Facilities and Skilled Nursing <br />Facilities’ (Article 31.2) – Moved this section from Article 31.2. to 32.11. Minor <br />changes to clarify that although residential care facilities are evaluated based <br />on how the space is used. Nonresidential uses and spaces used for care count <br />towards floor area ratio (FAR) intensity maximums, however any spaces that <br />meet the definition of a dwelling unit shall be subject to residential density <br />maximums. All other development standards will be applied regardless of <br />residential or nonresidential distinction. <br />‘Residential Structures’ (Article 31.10) – Move this section from 31.10 to 32.6. <br />Additionally, non-substantive updates to subsection titles are proposed. <br />g.Article 31 – Special Uses: Modernize language and/or update the review authority for <br />the following uses: <br />Excavations (Article 31.7) - This section regulates excavation of earth and <br />large grading unassociated with a development project. These regulations <br />have not been updated in decades, and the text requires modernization <br />throughout to understand its intent and applicability. The proposed <br />amendments would update zoning text and formatting to clarify the intent <br />and applicability of this section. No substantive changes are proposed. <br />Public Utilities Lines and Structures (Article 31.9) - This section regulates <br />public utility lines and structures, such as substations, pumping stations, <br />8.B. - Page 205 of 212 <br />520
