8 <br />Existing code language establishes a maximum fence height of 6 feet on <br />exterior side yards (secondary streets), while interior side and rear yards are <br />allowed to be 7 feet tall. The proposed amendment would allow exterior yard <br />fences facing a secondary street to be up to 7 feet tall consistent with the <br />fence height allowed for interior side and rear yards. <br />Update zoning text to clarify that Architectural Permit process to allow taller <br />fencing above 7 feet does not apply to Residential districts or the Professional <br />Office District. <br />l.Mobile Homes (Article 31.13) – Although Chapter 34 of the Municipal Code regulates <br />Mobile homes trailers, and mobile home parks, the Zoning Code contains supplementary <br />provisions in Article 31.13 and definitions in Article 2 that relate to state regulated <br />structures commonly found in mobile home parks. The Zoning Code has outdated <br />definitions or does not contain certain definitions established in State law for <br />manufactured homes, trailers, recreational vehicles, or mobile homes. The proposed <br />amendments would update Zoning Code definitions for mobile homes, trailers, <br />recreational vehicles, and manufactured homes to be consistent with State law. The <br />proposed amendments would also clarify that manufactured homes on a permitted <br />foundation, which are regulated by State law, are not regulated by the supplementary <br />provisions for mobile homes and trailers. <br />Municipal Code <br />As the City Council is the review authority for Municipal Code amendments, as such a Planning <br />Commission recommendation was not provided for these amendments. <br />1.Definitions –The proposed amendments are intended to revise existing definitions with minor <br />clarifications to help make them more precise, easier to understand and/or update code <br />references (e.g. “New Building(s)”, “Substantial Residential Remodeling”); <br />2.Chapter 2 (Administration) regulates the powers and duties of the City’s various boards, <br />commissions, and committees. The Board of Building Review consists of five members who are <br />qualified in the building construction fields and are appointed by City Council to review updates <br />to the City’s building regulatory codes. The proposed amendment would clarify that the Board of <br />Building Review would have the authority to hear appeals of building permits. <br />3.Chapter 5 (Animals and Fowl) regulates permits for animal and fowl on private property. The <br />following amendments are proposed for: <br />a.Number of Animals and Fowl Allowed - This Chapter currently allows up to three <br />chickens, roosters over four (4) months of age, geese, ducks, turkeys, or similar fowl or <br />8.B. - Page 208 of 212 <br />523
