The proposed amendments would increase the maximum allowable <br />animals and fowl per parcel from 3 to 5. <br />b.Review Authority and Permit Transfer – This Chapter allows an administrative permitting <br />process by the Building Inspector to issue a permit to allow horses, cows, goats or sheep <br />on private property. Section 5.49 of the Municipal Code requires the transfer of the <br />permit to a successive owner of the same property to be reviewed by the Planning <br />Commission and City Council but does not provide findings for how to determine whether <br />a transfer shall occur. The transfer of the permit has substantially more review <br />requirements than obtaining the original permit. The proposed amendments would: 1) <br />update the review authority from the Building Inspector to the Building Official or their <br />designee and; 2) allow permit transfer to another owner as an administrative action by <br />the Building Official or their designee without review by the Planning Commission and <br />City Council. <br />c.Review Authority for Additional Animals and Fowl - This Chapter allows up to two <br />horses, cows, goats or sheep on a lot with a minimum of one acre. Currently, Section 5.50 <br />of the Municipal Code requires the Planning Commission to approve one additional <br />horses, cows, goats or sheep on each acre, however there are no findings or approval <br />criteria. The proposed amendments would authorize the Building Official or designee <br />allow the additional horses, cows, goats or sheep by administrative action, as this Chapter <br />is regulated by objective standards for minimum lot size, spacing, and setbacks. <br />4.Chapter 30 (Subdivisions) <br />a.Remove State Bill Reference - Chapter 30 (Subdivisions) regulates land subdivisions. <br />Article XIII of Chapter 30 references the State-mandated ministerial review process to <br />allow subdivisions of up to 10 lots. The ministerial subdivision process located in <br />Government Code section 66499.41 was established by Senate Bill, SB 684, which has <br />since been amended by Senate Bill SB 1123. State laws are regularly amended with state <br />bill numbers that are reused, which may cause confusion in the future if the state bill <br />numbers are continued to be referenced in the City code.
