Commercial properties along Seaport <br />Boulevard and in Seaport Centre pay annually for the expense of maintaining and operating the <br />stormwater retention basin and landscaping along Seaport Boulevard. The proposed budget for the fiscal <br />year is $212,500. <br />ENVIRONMENTAL REVIEW <br />This action is categorically exempt from the California Environmental Quality Act (CEQA) under California <br />Code of Regulations, Title 14, Section 15301 (Class 1) because the assessments, if approved, will fund the <br />repair and maintenance of existing facilities. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />The City Council may choose not to approve this resolution and/or direct staff to pursue alternative <br />approaches to secure the required services. Alternatives include the following: <br />1. The City Council may choose to levy assessments and not supplement the District’s finances with City <br />funds. The assessment would continue to provide increased service levels to affected properties, but <br />not to the agreed to service level. By not supplementing the District’s budget, those funds become <br />available to other programs. This option contradicts the City’s commitment to provide a higher level <br />of service to the affected properties. <br />2. The City Council may choose to not levy assessments or provide supplemental funding to offset the <br />assessment amount. With this option, the District may have to reduce maintenance and operation of <br />the storm water retention system and landscaping along Seaport Boulevard.
