CEQA Findings: The City Council has considered the environmental <br />review previously prepared and certified, including the Final Environmental Impact Report <br />for the Downtown Precise Plan, certified on January 24, 2011 (State Clearinghouse No. <br />2006052027), and the Final Subsequent Environmental Impact Report for the Downtown <br />Precise Plan Plan-Wide Amendments, certified on June 26, 2023 (State Clearinghouse <br />No. 2021090249). The City Council has also considered its prior CEQA determination for <br />the Project, including Resolution No. 16254, adopted on October 28, 2024, by which the <br />City Council reviewed and approved a CEQA Consistency Checklist for the Project and <br />determined that the Project, including the proposed vacation and sale of City property, <br />was within the scope of the previously certified environmental review for the Downtown <br />Precise Plan and its Amendments and was consistent with Public Resources Code <br />Section 21083.3 and CEQA Guidelines Sections 15168 and 15183. <br /> <br />The proposed vacation and sale of the Spring Street Segment were components <br />of the previously approved and analyzed Project. The City Council finds that these actions <br />do not involve substantial changes to the Project, substantial changes with respect to the <br />circumstances under which the Project will be undertaken, or new information of <br />substantial importance that would require subsequent or supplemental environmental <br />review. Accordingly, no further environmental review is required for the vacation and sale <br />of the Spring Street Segment to Developer. <br /> <br />Section 3. The City Council finds that the Spring Street Segment as more fully <br />described in Exhibit 1 is unnecessary for present or prospective public purposes and that <br />its vacation as a public street is consistent with the objectives, policies and programs of <br />the City’s General Plan, as amended, and its Downtown Precise Plan, as amended, in <br />that the Project will promote the development of the downtown and provide off-site <br />affordable housing. <br /> <br />Section 4. The City Council finds that the Spring Street Segment includes property <br />that is long underutilized and finds that transfer and sale of the Spring Street Segment to <br />Developer is in the best interest of the City because it will relieve the City of its <br />maintenance obligations and potential liability associated with ownership of the Spring <br />Street Segment. The City Council also finds that sale of the Spring Street Segment to <br />Developer shall also further the objectives, policies and programs of the City’s General <br />Plan, as amended, and its Downtown Precise Plan, as amended, in that the sale will <br />promote the development of the downtown and provide for off-site affordable housing. <br /> <br />Section 5. As adopted in the DA, the City Council finds that the Purchase Price <br />represents the fair market value of the Spring Street Segment, and that the City is <br />receiving fair and adequate consideration in the sale of the Spring Street Segment. <br /> <br />Section 6. The City Council finds that the Spring Street Segment as more fully <br />described in Exhibit 1 is hereby ordered vacated, subject to the following conditions: (1) <br />that all conditions of closing of the escrow, as set forth in Section 5 of the Purchase <br />Agreement, and as determined by the City Attorney, have been met; (2) the existing utility <br />franchise facilities located within the Spring Street Segment and held by PG&E have been
