ATTY/RESO.0052/ CC RESO APPROVING SUBSTITUTE SITE AS AFFORDABLE HOUSING SITE (705 VETERANS)(1900 BROADWAY DA) <br />REV: 07-21-26 MI <br />Page 11 of 11 <br />and provisions for setting rents, marketing, income certification, and screening of <br />potential renters of units, including the financing of ongoing administrative and <br />monitoring costs, as applicable, consistent with the approved Amended and <br />Restated Affordable Housing Plan. <br /> <br />Except as otherwise provided for by the Affordable Housing Ordinance, the <br />Restrictive Covenant Agreement must provide the City with a right of reverter, right <br />of first refusal and option to acquire the donated land. The Restrictive Covenant <br />Agreement shall include a Performance Deed of Trust securing the affordable <br />housing obligation and an Assignment of Contracts (consistent with Zoning Code <br />Ordinance Section 29.8.H.12). The agreements shall be in a form acceptable to <br />the City Attorney and the Community Development Director. <br /> <br />Any further requests for modification, including but not limited to, changes to the <br />Amended and Restated Affordable Housing Plan, must be submitted in writing to <br />the City prior to issuance of the final building permit required for construction of the <br />Affordable Housing Project, pursuant to Government Code Section 65913.4(g)(1)- <br />(4). <br /> <br />Section 5.
