7. Affordability Term: The affordability term for the Project is 55 years from the date of the <br />certificate of occupancy. <br /> <br />8. Local Preference: The Project will comply with the City’s Local Preference requirements to the <br />extent permitted by law. <br /> <br />The Project also complies with the additional provisions contained in Section 29.6 of the Affordable <br />Housing Ordinance (which are not listed in Item N of the Affordable Housing Guidelines Checklist <br />addressed above): <br /> <br />9. Eligibility. No household will occupy an affordable unit until the Community Development <br />Director or designee has approved a Tenant Selection and Management Plan prepared by Eden <br />Housing, which plan shall include eligibility requirements specific to the project. <br /> <br />10. Principal Residence. Any household that occupies an affordable unit will occupy that unit as its <br />principal residence. <br /> <br />11. Guidelines. The Community Development Director may from time to time adopt "Affordable <br />Housing Guidelines" for determining household income and affordable housing cost, <br />determining buyer eligibility, monitoring, other relevant administrative provisions, providing <br />guidance related to requirements under the Ordinance, and determining acceptable alternative <br />means of compliance within the requirements of this Chapter. Eden will incorporate, to the <br />extent permitted by State regulations and lender and investor approval all reasonable <br />guidelines. <br /> <br />12. Conflict of Interest. Eden Housing’s employees or consultants will comply with all applicable <br />laws, regulations, and policies relating to conflicts of interest as to their eligibility to develop, <br />construct, sell, rent, lease, occupy, or purchase an affordable unit. <br /> <br />The Eden Project also will comply with the following conditions listed in Section 29.H of the Affordable <br />Housing Ordinance (which are not listed in the Land Donation Alternative Checklist included in pages 90- <br />94 of the Affordable Housing Guidelines addressed in Section VIII of this Amended and Restated <br />Affordable Housing Plan): <br /> <br />• 29.8H(8) states that “[t]he property to be donated is vacant undeveloped property; except that <br />the City, at its sole and absolute discretion, may accept property with existing improvements, so <br />long as the donor takes all necessary steps to avoid impacts on residents of existing residential <br />structures.” <br />o The Land Donation Site is currently developed with a 5,362 square foot commercial <br />building that consists of the following uses and occupancies: <br /> <br />ATTY/RESO.0052/ CC RESO APPROVING SUBSTITUTE SITE AS AFFORDABLE HOUSING SITE (705 VETERANS)(1900 BROADWAY DA) - EXHIBIT 1 <br />REV: 07-21-26 MI <br /> <br /> <br />Page 23 of 53
