ATTY/RESO.0052/ CC RESO APPROVING SUBSTITUTE SITE AS AFFORDABLE HOUSING SITE (705 VETERANS)(1900 BROADWAY DA) <br />REV: 07-21-26 MI <br />Page 4 of 11 <br />WHEREAS, after the public hearing, the City Council considered the staff report <br />and the materials submitted by the Developer to support its request, and all other <br />documents, reports, studies, memoranda, maps, oral and written testimony, and materials <br />in the City’s files and all adopted City planning documents relating to the project and the <br />property including the City’s General Plan, as amended, Downtown Precise Plan <br />(“DTPP”) as amended, Municipal Code, Zoning Ordinance, and other applicable City laws <br />and regulations, and all associated approved and certified environmental documents <br />(collectively, the “Record”). <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br /> <br />Section 1. The recitals set forth above are true and correct and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br /> <br />Section 2. CEQA: The City Council finds and determines that approval of a <br />Substitute Site (705 Veterans Blvd) as the Affordable Housing Site and designated <br />Affordable Housing Project in the 1900 Broadway DAand of an Amended and Restated <br />Affordable Housing Plan is not subject to the California Environmental Quality Act <br />(“CEQA”) pursuant to Public Resources Code Section 21080(b)(1) due to the fact that <br />approval of the underlying affordable housing project at 705 Veterans Boulevard has <br />already occurred and is considered ministerial under SB 35 (Government Code Section <br />65913.4) and SB 330. In accordance with Public Resources Code Section 21080(b)(1) <br />and CEQA Guidelines Section 15268, Ministerial Approvals are exempt from the <br />requirements of CEQA. <br /> <br />The City Council further finds and determines that even if the approval were <br />considered a project under CEQA, it would be exempt pursuant to CEQA Guidelines <br />Section 15061(b)(3) because it can be seen with certainty that the approval of a Substitute <br />Site and Amended Affordable Housing Plan would not have the potential to result in a <br />significant effect on the environment. As noted in the Record, no changes have occurred <br />in the proposed 1900 Broadway Project or the circumstances thereof, other than the <br />substitution of the Affordable Housing Site which is exempt from CEQA, that would cause <br />new significant impacts or a substantial increase in the severity of impacts identified and <br />analyzed in the Consistency Checklist, and no new information has emerged that would <br />materially change the analysis or conclusions set forth in the Consistency Checklist which <br />concluded the 1900 Broadway Project was within the scope of the DTPP EIR and SEIR <br />and consistent with consistent with Public Resources Code Section 21083.3 and CEQA <br />Guidelines Sections 15168 and 15183. <br /> <br />Section 3. After due consideration of the Record, the City Council approves the <br />Amended and Restated Affordable Housing Plan and Developer’s request for the <br />Substitute Site under 1900 Broadway DA and finds that the that the Substitute Site meets <br />all of the following conditions: <br />
