Upon adoption, the <br />recommendation shall be transmitted to the City Clerk for presentation to the City Council. <br />3. The Board of Building Review shall determine the suitability of alternate materials and types of <br />construction with respect to meeting the standards and requirements of Chapter 9 of this Code <br />(including all codes adopted therein by reference) and as such provisions may be amended. <br />4. All such determinations shall be for purposes of clarification and shall be of uniform application <br />throughout the City and shall not operate to create an exception from any provision of this <br />Code, other ordinances of the City or State law. <br />D. Appeals from Denial of Building Permit, Inspection Approval, Certificate of Occupancy. <br />1. Any person who is denied a building permit for the reason that the material or type of <br />construction intended to be used is not deemed to be in compliance with the provisions of <br />Chapter 9 of this Code by the Building Inspector, and any person who is denied an inspection <br />approval or a temporary or final certificate of occupancy for the reason that the material used <br />or type of construction employed is not deemed to be in compliance with the provisions of <br />such provisions by the Building Inspector, may appeal to the Board of Building Review. <br />2. Every appeal, as provided by subsection 1 of this Section, shall be in writing on forms approved <br />by the Board of Building Review and furnished by the Building Inspector. Every such appeal <br />shall be filed with the Building Inspector at least fifteen (15) days prior to being considered by <br />the Board. Every such appeal shall indicate the Code provision or provisions concerned, the <br />nature of the appeal, the type of material or construction intended to be used, and shall be <br />accompanied by such drawings, plans, information or other materials deemed appropriate by <br />the Board. <br />3. The appellant or any other interested person may submit, in writing, his comments and <br />recommendations concerning the subject matter of appeal. The Board of Building Review may, <br />at its discretion, permit the appellant or any other interested person to appear and make oral <br />comments and recommendations on the subject matter of the appeal. <br />4. All determinations shall be adopted by motion. Copies of the motion shall be transmitted in <br />writing to the Building Inspector and to the person appealing. The Building Inspector shall <br />permanently maintain a copy of each determination for public inspection.
