<br /> <br />6.2F <br />age 1 <br /> <br />January 11, 2009 <br /> <br />SUBJECT <br />Resolution approving the appointment of an Interim City Attorney <br /> <br />RECOMMENDATION <br />1. By resolution: Authorize the terms of employment for the position of Interim City <br />Attorney. <br />2. Appoint Roy C. Abrams to the position of Interim City Attorney for the City of <br />Redwood City effective January 18,2010. <br /> <br />BACKGROUND <br />In December, 2009, City Attorney Stan Yamamoto announced his intentions to resign <br />on January 15th, 2010. Given the timeframe necessary for a rigorous and thorough <br />selection process for a permanent appointment, and the immediacy of the current City <br />Attorney's departure from the City, the Council authorized an ad-hoc of the Council and <br />the Human Resources Director to recruit and select candidates for an Interim City <br />Attorney. The Interim City Attorney position would be a limited term appointment that is <br />expected to last no more than six months. The interim City Attorney will fulfill the duties <br />of City Attorney and assist in the transition process while the recruitment for a <br />permanent City Attorney is conducted. <br /> <br />The ad-hoc committee interviewed candidates, and recommends Roy C. Abrams for <br />the appointment to Interim City Attorney effective January 18, 2009. Abrams is a former <br />City Attorney, and has served neighboring jurisdictions in that capacity for many years. <br />Abrams possesses the specialized skills and experience necessary to fulfill the duties of <br />the Interim City Attorney position. <br /> <br />It is recommended that the employment of Roy C. Abrams be on an hourly basis at the <br />rate of $170 per hour. As an hourly employee, Abrams would receive no benefits, <br />including health care, 401 (a) deferred compensation contribution, allowances for <br />vacation, overtime, sick leave, or holidays or any other benefit as prescribed in the <br />City's Executive Management Summary of Benefits. Abrams' hours would not exceed <br />960 hours in Fiscal Year 2010-2011, unless authorization is requested from CalPERS <br />as required by Government Code Section 21221 (h). The maximum duration of <br />employment is six months. This appointment can be terminated by either party, at any <br />time, with a two week written notice. Section 21 of the City Charter requiring a super- <br />majority vote of the Council to terminate the permanent City Attorney will not apply to <br />the interim appointment. <br />
