Consultations with NOAA Fisheries will likely be <br />necessary in order to ensure that the project does not result in adverse impacts to listed <br />fish species. <br /> <br />E. Standards for Issuing Permits/Findings/Mitigation Requirements. <br /> <br />The Federal Emergency Management Agency ("FEMA") is responsible for <br />management of areas within a designated 1 OO-year floodplain. FEMA requires that local <br />governments covered by federal flood insurance pass and enforce a floodplain <br />management ordinance that specifies minimum requirements for any construction within <br />the 100-year floodplain. <br /> <br />DMB's application states the site is located within a designated 100-year <br />floodplain. (DMB, Saltworks 50/50 Balanced Plan, Environmental Assessment (May 19, <br />2009), pp. 10-11.) In order to remove the area proposed for development from the 100- <br />year floodplain, DMB proposes to construct a perimeter levee. DMB' s application states <br />the levee will be constructed so that it can be raised in order to accommodate potential <br />sea level rise. (DMB Saltworks, Infrastructure (May 14, 2009), pp. 4-5.) In the event the <br />City decides to commence the environmental review process, the analysis will have to <br />address flood risks at the site. Adjacent land south of the site experiences intermittent <br />flooding under current conditions. The analysis will have to consider whether the project <br />will affect this existing problem. We recommend consulting with FEMA with respect to <br />these issues. <br /> <br />21 <br />
