Standards for Issuing Permits/Findings/Mitigation Requirements. <br /> <br />The jurisdiction of the San Francisco Bay Conservation and Development <br />Commission ("BCDC") extends to proposed development within 1 00 feet of the <br />shoreline of the bay. BCDC's jurisdiction also extends over salt ponds located around <br />the bay. (Gov. Code, ~ 66610, subd. (c ).) BCDC therefore has permitting authority over <br />the project. BCDC's policies derive from the McAteer-Petris Act, and from the "San <br />Francisco Bay Plan" -- the plan setting forth BCDC' s goals and policies with respect to <br />development affecting the bay. <br /> <br />BCDC exercises its authority by requiring proposed projects within its jurisdiction <br />to obtain a permit. A "major permit" is required for work that is more extensive than a <br />minor repair or improvement. A public hearing is held on an application for a major <br />permit and the application may be reviewed at hearings held by the engineers and <br />designers who advise BCDC. Applications for major projects are often evaluated by the <br />BCDC Design Review Board. The Design Review Board provides guidance on <br />appearance and design issues as well as on the adequacy of the public access in a <br />proposed project. Typical permit conditions include requirements to construct, guarantee <br />and maintain public access to the bay, specified construction methods to assure safety or <br />to protect water quality, plan review requirements that must be met before construction <br />can begin, and mitigation requirements to offset the adverse environmental impacts of the <br />project. <br /> <br />23 <br />
