San Francisco Bay Area Seaport Plan

3. Standards for Issuing Permits/Findings/Mitigation Requirements.

The jurisdiction of the San Francisco Bay Conservation and Development
Commission ("BCDC") extends to proposed development within 1 00 feet of the
shoreline of the bay. BCDC's jurisdiction also extends over salt ponds located around
the bay. (Gov. Code, ~ 66610, subd. (c ).) BCDC therefore has permitting authority over
the project. BCDC's policies derive from the McAteer-Petris Act, and from the "San
Francisco Bay Plan" -- the plan setting forth BCDC' s goals and policies with respect to
development affecting the bay.

BCDC exercises its authority by requiring proposed projects within its jurisdiction
to obtain a permit. A "major permit" is required for work that is more extensive than a
minor repair or improvement. A public hearing is held on an application for a major
permit and the application may be reviewed at hearings held by the engineers and
designers who advise BCDC. Applications for major projects are often evaluated by the
BCDC Design Review Board. The Design Review Board provides guidance on
appearance and design issues as well as on the adequacy of the public access in a
proposed project. Typical permit conditions include requirements to construct, guarantee
and maintain public access to the bay, specified construction methods to assure safety or
to protect water quality, plan review requirements that must be met before construction
can begin, and mitigation requirements to offset the adverse environmental impacts of the
project.

23
