Public and private entities may apply to the SLC for <br />leases or permits to provide access to or the right to use State lands. The terms and <br />conditions of such leases are subject to negotiation on a case by case basis. <br /> <br />SLC, BCDC and DMB have exchanged correspondence concerning the extent to <br />which the Saltworks site falls within SLC jurisdiction. We have obtained copies of this <br />correspondence, and have discussed the correspondence with SLC staff. The <br />correspondence occurred from March to May 2009. The correspondence indicates that <br />the SLC patented the Saltworks site to Leslie Salt in 1968. Surrounding lands, including <br />an adjacent parcel containing the "flood slough," remain subject to SLC jurisdiction and a <br />public trust easement. SLC staff confirmed this understanding during the course of <br />follow-up telephone calls. <br /> <br />We have obtained maps from SLC that appear to show what land is within SLC <br />jurisdiction, and what land falls outside of SLC jurisdiction by virtue of the patents <br />granted by SLC to Leslie Salt. If the City decides to move forward with the <br />environmental review process, then the extent of SLC jurisdiction will need to be <br />confirmed. <br /> <br />F.
