<br />7A - ATTACHMENT NO.3 <br />Saltworks Proposal- Water Group Summary Report (22 January 2010) Page 9 <br /> <br />· Quantitative or semi-quantitative computational analysis for the purpose of <br />corroborating or confirming City and OMS analyses; <br /> <br />· Determination of feasibility or sustainability of a particular project element <br />based on consistency with applicable laws, regulations, policies, practices, <br />and water industry norms; <br /> <br />· Validation of results or findings against results in similar cases; and <br /> <br />· Verification of results or findings with the City and OMS. In many cases, <br />OMS and City representatives were in agreement with the authors' results <br />and conclusions. In a few cases, the authors' results and conclusions were <br />modified in response to a clarification or updated information. In a few cases, <br />the authors came to a different result or conclusion than did OMS; in these <br />cases this report reflects authors' perspective and differences with OMS. <br /> <br />The specific methods and approaches used to evaluate the water demand and supply <br />elements of the OMS proposal are described in association with results in subsequent <br />chapters of this report. <br /> <br />Policy issues and implementation uncertainties identified herein represent those <br />identified by the authors in the course of their analyses. Should the City and OMS <br />choose to proceed with a complete environmental review (i.e., preparation of an <br />environmental impact report), identification and evaluation of additional policy and <br />implementation issues would be expected. Likewise, apparent feasibility based on this <br />analysis does not assure project implementation even if the City were to grant all <br />necessary approvals. Numerous other public agencies have discretionary permitting <br />authority over the project and one or more such agencies could deny an approval such <br />that the project could not be constructed as proposed. This report identifies key <br />approvals associated with water supply upon which the project is contingent and issues <br />associated with such approvals, but the report authors do not purport to predict or <br />assure any particular outcome of future permitting processes. <br /> <br />1.3 Report Authors <br /> <br />Senior experts were retained by Hart Howerton at the request of the City to evaluate the <br />water demand and supply component of OMS's proposal; this group is called the "water <br />team" in this report. Each of these experts contributed to this report, and they are (in <br />alphabetical order): <br /> <br />· Whitman F. Manley, Remy, Thomas, Moose and Manley LLP - 22 years of <br />experience in California environmental law, including the California <br />Environmental Quality Act and other State and Federal laws governing land <br />use and environmental resources. <br /> <br />· Virginia Porter, Virginia Porter Consulting Services - speCializing in urban <br />water resource planning and management; 21 years of public agency and <br />private consulting experience serving public and private interests in Northern <br />California. <br /> <br />2 <br />
