(Ord. 2009-6 9 1, 2009). <br /> <br />7.46.030 REGISTRATION OF COLLECTIVES. Primary Caregivers, <br />Qualified Patients, and Persons with Identification Cards cultivating medical <br />marijuana at a collective shall register with the Police Chief, providing the name <br />of a responsible party, a telephone number, the place of operation of the <br />collective, and such other information as may be reasonably required by the <br />Police Chief. (Ord. 2009-6 9 1, 2009). <br /> <br />ARTICLE 2. LICENSING REQUIREMENT AND PROCEDURE <br /> <br />7.46.040 REQUIREMENT FOR CITY LICENSE. <br />(a) Only Qualified Patients, Persons with Identification Cards and Primary <br />Caregivers may cultivate and store medical marijuana collectively. Medical <br />marijuana collectives are required to obtain a license to operate within the City of <br />San Mateo. <br />(b) An application for a license under this Chapter shall include: <br />(1) a warning that persons collectively cultivating medical marijuana at <br />facilities licensed under this Chapter may be subject to prosecution under federal <br />laws. <br />(2) the applicant's waiver and release of the City from any and all legal <br />liability related to or arising from the application for a license, the issuance of the <br />license, or the enforcement of the conditions of the license, and/or the operation <br />of any facility at which where medical marijuana is collectively cultivated. (Ord. <br />2009-6 9 1, 2009). <br /> <br />7.46.050 LICENSE PROCEDURE. <br />(a) Every person who proposes to participate in the collective or cooperative <br />cultivation and/or storage of medical marijuana in the City of San Mateo shall file <br />an application with the License Committee upon a form provided by the City of <br />San Mateo Police Department and shall pay a filing fee, as established by <br />resolution adopted by the City Council. <br />(b) Applications shall include the following information: <br />(1) Each individual member of the cooperative or collective shall state <br />their legal name (including any aliases), address, and telephone number. <br />(2) Each individual member of the cooperative or collective shall provide <br />evidence that they are a qualified patient, person with an identification card, or a <br />primary caregiver. <br />(3) If the applicant is a cooperative, it shall provide a copy of its articles <br />of incorporation and shall provide the information required by subsections (b)(l) <br />and (b)(2) for each of its members. <br />(4) The proposed address where the applicants intend to cultivate and/or <br />store medical marijuana, plus the names and addresses of the owners of the <br />proposed site. <br />(5) The address to which notice of action on the application is to be <br />mailed. <br />(c) Upon receipt of a completed application and payment the fee, the License <br />Committee shall promptly investigate the information contained in the application <br />to determine whether the applicant shall be issued a license. <br />(d) The License Committee shall approve a license application, unless: <br /> <br />http://www.cLsanmateo.ca.us/index.aspx?NID= 1757 &PREVIEW=YES <br /> <br />1/14/2010 <br />
