<br />San Mateo, CA - Official Website - 7.46 Medical Marijuana Collectives Reg. <br /> <br />Page 4 of6 8A <br />Page 29 <br /> <br />(1) The building, structure, equipment, or location for which a license is <br />requested does not comply with the requirements and standards of the health, <br />zoning, fire and safety laws of the City and the State of California, or with the <br />development and performance standards and requirements of the regulations <br />contained in this Chapter. <br />(2) The applicants have knowingly made any false, misleading or <br />fraudulent statement of material fact in the application for the license. <br />(3) The required application fee has not been paid. <br />(4) The applicant has failed to provide a complete application. If an <br />application is denied on this basis, the License Committee shall state the <br />information that is needed to make the application complete. <br />(e) The License Committee shall make its determination within thirty (30) <br />business days of receipt of the completed application and fee. If the application is <br />granted the license shall be placed in the Unites States mail, first class postage <br />prepaid, addressed to the applicant at the address stated in the application. <br />(f) If the License Committee neither grants nor denies the application within <br />thirty (30) business days after it is stamped as received, the applicant may begin <br />operating the collective or cooperative for which the license was sought, subject <br />to strict compliance with the development and performance standards and <br />requirements of this Chapter. If the applicant begins operating the collective or <br />cooperative because the License Committee has not granted or denied the <br />application within thirty (30) business days, the License Committee may issue the <br />permit after the thirty day period has elapsed, and the permit shall be subject to <br />revocation under the provisions of section 7.46.070. COrd. 2009-6 ~ 1, 2009). <br /> <br />7.46.060 CONDITIONS OF LICENSE. <br />(a) The City License will include, at a minimum, the following conditions: <br />(1) Only qualified patients, persons with identification cards, and primary <br />caregivers may cultivate medical marijuana collectively or associate for the <br />purpose of doing so. <br />(2) Absolutely no advertising of marijuana is allowed at any time. <br />(3) Exterior signage is limited to site addressing only. <br />(4) The collective site will be monitored at all times for security purposes. <br />(5) A centrally monitored alarm system is required. <br />(6) Interior building lighting, exterior building lighting and parking area <br />lighting will be of sufficient foot-candles and color rendition, so as to allow the <br />ready identification of any individual on site at a distance of no less than forty <br />feet. <br />(7) Windows and roof hatches will be secured with bars on the windows <br />so as to prevent unauthorized entry, and be equipped with latches that may be <br />released quickly from the inside to allow exit in the event of emergency. <br />(8) No marijuana product may be visible from the building exterior. <br />(9) The activities that may be conducted at a licensed collective are <br />limited to cultivation of marijuana for personal use and preparation of cultivated <br />marijuana for personal use, such as drying and processing. <br />(10) No cooking, preparation, or manufacturing of marijuana enhanced or <br />edible products, including but not limited to cookies, candy, or brownies is <br />allowed. <br />(11) No sales of marijuana are allowed on site. <br />(12) No persons under the age of eighteen are allowed on site, unless <br />such individual is a qualified patient and accompanied by their licensed attending <br />physician, parent or documented legal guardian. <br />(13) The quantity of marijuana located at the facility where medical <br />marijuana is collectively cultivated may not exceed the maximum quantity of <br />medical marijuana authorized by state law needed by the patients who are served <br />by the collective, consistent with the regulations set forth in this Chapter. <br /> <br />http://www.cLsanmateo.ca.us/index.aspx?NID= 1757 &PREVIEW=YES <br /> <br />1/14/2010 <br />
