Mitigation Measure BIO-15a, b, and c: would address impacts on State-regulated <br />habitats, including isolated wetlands (i.e., wet meadow, freshwater marsh, seasonal) and <br />riparian habitat throughout the alignment <br /> <br />Impact BIO -17: Conflict with local tree preservation ordinances by removing or damaging <br />locally protected trees. <br /> <br />Project excavations and pipeline and valve vault construction would require the removal of <br />mature native and non-native trees that qualify as significant, heritage~ or otherwise locally <br />protected trees. In addition, grading or trenching within their drip lines could result in tree <br />mortalities or reduced tree vigor, leading to future mortalities. The jurisdictions in which the <br />Project would be constructed include the cities of Fremont, Newark, East Palo Alto, Menlo Park~ <br />Palo Alto~ and Redwood City, and unincorporated San Mateo County. These jurisdictions have <br />ordinances that define significant and/or heritage trees and regulate their removal or pruning. <br />Potentially significant tree removal impacts would occur in Fremont; in Newark; in Menlo Park; <br />in Redwood City, and in unincorporated San Mateo County <br /> <br />. Mitigation Measure BIO 17a: Tree survey <br />. Mitigation Measure BIO 17b: Replace significant, heritage, landmark, or othetwise <br />protected trees <br />. Mitigation Measure BIO- 17 c: Perform necessary pruning; plant replacement trees; <br />monitor remedial tree plantings <br /> <br />Impact CR -la: Impacts on archaeological resource sites tbat are potentially NRHP and <br />CRHR eligible. <br /> <br />Construction of the Project has the potential to affect significant archaeological sites. The <br />pipeline segments in the East Bay and Peninsula would be installed below ground by a <br />combination of open cut trenching along the majority of the right of way for BDPL Nos. 1 and 2 <br />and trenchless methods, such as micro tunneling or jack-and-bore, under railways, major <br />thoroughfares, and certain drainages. Presently, no archaeological sites within the proposed <br />study area have been listed in either the California Register of Historical Resources (CRHR) or <br />the National Register of Historic Places (NRHP). Five prehistoric archaeological sites <br />previously had been recorded, and one additional prehistoric site was located during the <br />pedestrian reconnaissance of the study area. Direct impacts from trenching for BDPL No. 5 <br />would be potentially significant for sites retaining integrity, given the paucity of investigations of <br />similar prehistoric sites in the South Bay. <br /> <br />. Mitigation Measure CR-la: Retain a qualified archaeological consultant; undertake an <br />archaeological testing program (A TP); conduct an archaeological monitoring and/or data <br />recovery program, if required; suspend construction, as necessary <br />.
