<br />6.1E <br />Page 1 <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the Cit Mana er <br /> <br />February 8, 2010 <br /> <br />SUBJECT <br />Amendments to Professional Service Agreements for Hart Howerton and Data Instincts <br />related to Processing the Saltworks Development Proposal <br /> <br />RECOMMENDATION <br />1) Approve, by motion, Amendment No. 3 to the professional services agreement with <br />Hart Howerton to assist the City in the environmental consultant selection process <br />and on- going review and management services related to the review of the <br />Saltworks development proposal, in an amount of $301,050.00. <br /> <br />2) Approve, by motion, Amendment No.2 to the professional services agreement with <br />Data Instincts for public information services related to the review of the Saltworks <br />development proposal, in an amount not to exceed $90,000.00. <br /> <br />BACKGROUND <br />On August 10, 2009, the City Council initiated a General Plan Amendment for the <br />Cargill property in response to the Saltworks development proposal, as submitted on <br />May 19, 2009. As previously discussed, the City's evaluation process will require <br />retaining a range of project consultants, which will include, but not be limited to, the <br />fields of legal, environmental, public information, project management, and specialized <br />technical topics. <br /> <br />Hart Howerton <br />On September 14, 2009, the City retained the planning firm Hart Howerton to assist City <br />staff in the review process for the Saltworks development proposal. Hart Howerton's <br />tasks included reviewing the application to determine if it was adequate for continued <br />City review, and identifying significant issues that may require further review. This <br />processes culminated in the publishing of three Tier One Summary Reports, which were <br />presented to the City Council and community on February 1, 2010. The conclusion <br />stated in all three of the Tier One Summary Reports is that the Saltworks application <br />does not contain fundamental insurmountable issues that would prevent the <br />continuation of processing the application. Because no insurmountable issues have <br />been identified, City staff is now ready to continue processing the application and initiate <br />the public outreach and California Environmental Quality Act (CEQA) process. <br /> <br />The CEQA process would provide a framework for the detailed analysis of the <br />development proposal. The CEQA process would also serve to identify the significant <br />effects on the environment, identify alternatives, provide meaningful public input and <br />comment periods, and provide a means for other responsible agencies to comment on <br />the development proposal. <br />
