<br />8A <br /> <br />It is also proposed that effective February 10, 2010 residents be assessed a fee if they dcPage 2 <br />not bring their solid waste container(s) to the curbside. This proposed change will affect <br />only those subscribers who elect to have their solid waste collected at the side yard or <br />backyard. This proposed change is being made to make collection rates more equitable <br />and to improve the efficiency of solid waste collection operations. An exception will be <br />granted to those individuals who are physically unable to take their garbage container(s) to <br />the curb. <br /> <br />The following is a representative example of the proposed residential pull charges: <br /> <br />0-50 Feet: <br />1 Cart <br />2 Carts <br />3 Carts <br />4 Carts <br /> <br />$18.00/month <br />$28.72/month <br />$57.44/month <br />$86.16/month <br /> <br />51-100 Feet: <br />1 Cart <br />2 Carts <br />3 Carts <br />4 Carts <br /> <br />$21.00/month <br />$31 .72/month <br />$60.44/month <br />$89.16/month <br /> <br />Should the Council elect to implement residential pull charges the Finance Department will <br />work with Allied to develop a public information program advising affected residents of this <br />change and will provide ample time before implementing these changes. <br /> <br />Public Notice <br />In July 2006, the California Supreme Court determined that water consumption charges are <br />property-related charges and increases in such charges are subject to the procedural <br />provisions of Proposition 218. As a result of this decision, many public agencies are now <br />also following the procedural provisions of Proposition 218 for increasing solid waste rates <br />as there is some chance that the Court would also find that these charges are property- <br />related fees. Accordingly, staff followed the procedural provision of Proposition 218 and <br />mailed notices of this proposed rate increase to all addresses in Redwood City that receive <br />solid waste services advising subscribers and property owners of this recommended rate <br />increase. <br /> <br />Under certain provisions contained within Proposition 218, if a majority of the affected <br />property owners files a written protest against the proposed rate increase, the governing <br />body may not approve the proposed increase. <br /> <br />Since the deadline for submitting such written protests is 5:00 p.m. on Monday, February 8, <br />staffwill advise the Council with the number of protests filed as part of the oral presentation <br />of this recommendation at the Council meeting. <br /> <br />Utilities Committee Recommendation <br />The Council Utilities Committee reviewed these proposals at their December 9, 2009 <br />meeting and recommended that they be brought before the full Council for consideration. <br /> <br />ALTERNATIVES <br />Council may elect not to approve this proposed increase but in doing so may expose the <br />City to legal action initiated by Allied Waste Industries as the proposed rate increase is <br />based on methodology that is contained in the franchise agreement for solid waste and <br />recycling collection services between the City and Allied. <br /> <br />FISCAL IMPACT <br />Since the City, in accordance with the franchise agreement, does not pay Allied for the <br />collection of the City's solid waste, there will be no cost impact to the City if this rate <br />
