6.3D Page 16 ATTACHMENT 2 change to the Leased Premises occasioned by the installationt maintenance or removal of Lessee's improvements, fixtures, furnishings and equipment, and restore the Leased Premises to the same condition as when Lessee received the property from Lessor, normal wear and tear excepted. 5.02 Lessor's Rights. If Lessee fails to perform Lessee's obligations under this Article 5 or under any other provision of this Lease, Lessor may at its option (but shall not be required to) enter upon the Leased Premises after prior notice to Lessee (except in the case of an emergency, in which case no notice shall be required), to perfonn such obligations on Lessee's behalf and put the same in good order, condition and repair, and the cost thereof together with interest thereon at the maximum rate then allowable by law shall become due and payable. 5.03 Lessor's Oblif:zations. Lessee shall maintain in good order and repair the structural portions of the structure(s) in which Lessee's equipment is located. Lessor shall have no obligation to repair and/or maintain the Leased Premises nor the improvements thereto and facilities placed thereon by Lessee, except if such repairs are required due to the sole negligence OT willful misconduct of Lessor or its agents or employees. 5.04 Security Measures. Lessor has no obligation to provide any security measures at the Emerald Lake Hills Water Tank Property other than those the Lessor in its discretion determines are needed for its own facilities. Lessee may provide reasonable security measures for its facilities provided that such measures shall not limit Lessor's use of the Emerald Lake Hills Water Tank Property in any way consistent with the terms and conditions of this agreement.
