<br />6.30 <br />Page 32 <br /> <br />ATTACHMENT 2 <br /> <br />Lessee's Facilities from the Leased Premises to any other portion of the Emerald Lake <br /> <br />Hills Water Tank Property (the "Alternate Leased Premises"), subject to the tenns set <br /> <br />forth below; provided, however, that the reason for the relocation is that Lessor has <br /> <br />decided to proceed with its water tank replacement project replacing the two wood water <br /> <br />tanks currently located on the Emerald Lake Hills Water Tank Property. <br /> <br />(b) The size, location and dimensions of the Alternate Leased Premises shall <br /> <br />be chosen by Lessor but must, in Lessee's reasonable judgment, be at least as suitable for <br /> <br />purposes of operating a communications facility as the size, location and dimensions of <br /> <br />the Leased Premises. If the Alternate Leased Premises are not suitable for Lessee's <br /> <br />operations, as determined by Lessee in its reasonable judgment, then Lessor shall not <br /> <br />require Lessee to relocate to such Alternate Leased Premises and Lessee shall remain on <br /> <br />the Leased Premises until the expiration or earlier tennination of this Lease. <br /> <br />(c) Lessee shall not be required to relocate the Lessee Facilities to any <br /> <br />location which would result in any deterioration or diminution of the quality of <br /> <br />communication services or other services provided by Lessee from the Leased Premises, <br /> <br />nor shall Lessee be required to conduct such relocation in a manner which would cause <br /> <br />any deterioration or diminution of such quality or which would cause any interruption of <br /> <br />such services. <br /> <br />(d) The relocation of the Lessee's Facilities to the Alternate Leased Premises <br /> <br />shall not cause the Rent payable under the Lease to be increased. <br /> <br />(e) The relocation of the Lessee's Facilities to the Alternate Leased Premises <br /> <br />shall be accomplished by Lessee at Lessee's sole cost and expense. <br /> <br />LeaseAgreement.CommunicationsSite - 02102106 <br /> <br />SITE #599A <br /> <br />24 <br />
