No decisian is required at this <br /> time. <br /> BACKGR4UND <br /> In 2007, the City certified an Environmental Impact Report (EIR}, Precise Plan, Zaning <br /> Map,and General Plan Amendment for powntown Redwood City,constituting appro�al of <br /> #he Downtown Precise Plan(DTPP). The Plan established a contemporary vision for the <br /> Downtown and set forth the specifc land use parameters, de�elopment standards, <br /> architectural guidelines,and urban design criteria in order to create a unique and vibrant <br /> Downtown. In February 2009,as a resul#of a legal chalienge to the EIR,the Court ordered <br /> fihe City to set aside the DTPP approvals including the final EIR certification, DTPP <br /> adoption and Zoning Map amendment.The Court identified three primary deficiencies in <br /> the 20Q7 EIR as a basis for its decision. They were: <br /> • The 2007 EIR did not adequately address the potential shadow impacts which <br /> would result from new DTPP building heights; <br /> • The 2007 EIR did not adequately address the protection of historic resources, <br /> including historic structures, in the Downtown; <br /> . The 2007 EIR did nofi adequately address the potential for an"altemate site"for the <br /> project. <br /> On March 23,,2009 the Ci#y Council adopted an Ordinance setting aside the previous <br /> DTPP approu�ls in compliance with the Caurt's mandate.This action was taken to permit <br /> the City to fiocus on completion of a new DTPP and EIR. <br /> �n July 13,2009, the Cfty entered intfl an agreement with Wagstaff and Associates for <br /> environmentai consulting services to re-write the Downtown Precise Plan EIR based on the <br /> Court's requirements. Al�hough the entire EIR will be rewritten to comply with the California <br /> Environmental Quality Aet (CEQA} requirements, the major areas o#work will be the <br /> � lawsuit-refated subjects of shadows, historic resources and project alternatives. Also,a <br /> new traffic analysis will be required to reset the baseiine traffic data which in turn wiil be a <br /> basis for new noise,air quality,and greenho�ase gas emission evaluations. Some of these <br /> s#udies are dependent or� ongoing work on the New General Plan which,has now <br /> pragressed. <br />
