March 22,2010 SU�JECT Status Report on the New Draft Downtown Precise Plan Recommendation Consider update on the new Draft Downtown Precise Plan. No decisian is required at this time. BACKGR4UND In 2007, the City certified an Environmental Impact Report (EIR}, Precise Plan, Zaning Map,and General Plan Amendment for powntown Redwood City,constituting appro�al of #he Downtown Precise Plan(DTPP). The Plan established a contemporary vision for the Downtown and set forth the specifc land use parameters, de�elopment standards, architectural guidelines,and urban design criteria in order to create a unique and vibrant Downtown. In February 2009,as a resul#of a legal chalienge to the EIR,the Court ordered fihe City to set aside the DTPP approvals including the final EIR certification, DTPP adoption and Zoning Map amendment.The Court identified three primary deficiencies in the 20Q7 EIR as a basis for its decision. They were: • The 2007 EIR did not adequately address the potential shadow impacts which would result from new DTPP building heights; • The 2007 EIR did not adequately address the protection of historic resources, including historic structures, in the Downtown; . The 2007 EIR did nofi adequately address the potential for an"altemate site"for the project. On March 23,,2009 the Ci#y Council adopted an Ordinance setting aside the previous DTPP approu�ls in compliance with the Caurt's mandate.This action was taken to permit the City to fiocus on completion of a new DTPP and EIR. �n July 13,2009, the Cfty entered intfl an agreement with Wagstaff and Associates for environmentai consulting services to re-write the Downtown Precise Plan EIR based on the Court's requirements. Al�hough the entire EIR will be rewritten to comply with the California Environmental Quality Aet (CEQA} requirements, the major areas o#work will be the � lawsuit-refated subjects of shadows, historic resources and project alternatives. Also,a new traffic analysis will be required to reset the baseiine traffic data which in turn wiil be a basis for new noise,air quality,and greenho�ase gas emission evaluations. Some of these s#udies are dependent or� ongoing work on the New General Plan which,has now pragressed.
