<br /> The apparent low bid of $1,261,f84.65 submitted by Elite Landscaping Inc. is 26°/a
<br /> lower than#he enginees's estimate of$'1,698,033.00 for fhe cost of constructian, and the
<br /> apparent second low bid of $1,330,89�.00 submitted by Goodland Landscape
<br /> Construction Inc. is 22% lower than the engineer's estimate. However, s#aff has
<br /> determinet#the law bid to be"not responsible"due to lack of experience on projects of a
<br /> simiiar nature, and the second low bid to be"non-responsive." The Addendum No.1 to
<br /> the Contract Documents, states "minimum experrence requiremenfs of the prrme
<br /> contractor shal! rnclude the complefion of 5 projects, each of whrch included the
<br /> insta!lation of synthefic turf playing frelds af least 50,000 s.f in size, involving contract
<br /> d�llar amounts of ar least$�million each, within fhe past 5 years." Staff has evaluated
<br /> the experiences of Elite Landscaping (nc. and Goodland Landscape Consfirucfiion, Inc.,
<br /> and contacted the references�rovided.
<br /> Elite Landscaping [nc. has been determined "not responsibfe° because of the seven
<br /> proyects provided as reference, four projects are located outside of the United States,
<br /> one project was not completed within the past fi�e years, one project contact number is
<br /> disconnected, and one project contact stated that fhe projec# cor�tractor was not Elite
<br /> Landscaping 1nc. Eiite claims that the project for which the project contact states Elite
<br /> was not the contractor should be attributable to Elite because current Elite project
<br /> manager, Sergio Del Rio, worked on that project, even though at the time Mr. Rio was
<br /> working for a different contract company; the City has determined that the project
<br /> cannot be attrib�table ta El�te.
<br /> On March 5, 201 a Elite Landscaping Inc. submitted an electranic message con#aining
<br /> addifionaE foreign project references. Staff responded by s#ating "due to differences in
<br /> standards, such as testing, compliance, and publi� contract code, projects performed
<br /> outside of the Unites States can not be considered as similar,comparable projects",and
<br /> requested domestic pro�ect references from Elite. In addition, on March 16, 2010, staff
<br /> requested that Elite submit copies of the contract dacuments for the foreign projects
<br /> referenced tha#show Elite as the general contractor. As of the end of business March
<br /> 17, 2010, staff has not received any of the requested documents from Eli#e. Based on
<br /> the foregoing facts, City Staff a�rms its initial determination that Elite Landscaping, Inc.
<br /> is not responsible.
<br /> Goodland Landscape Constructian, Inc. has beer� determined "non-responsive"
<br /> because two of the five synthetic field prajects submitted were not completed within the
<br /> past five years as documented by#he Notice of Completion filed by the owner.
<br /> Bid Award
<br /> The third lowest bidder, Robert A. Bothman, Inc., submitted a responsive and
<br /> responsible bid of $1,421,128.00, which is 16% lower than the engineer's estimate.
<br /> Robert A. Bothman, Inc. has successfully completed similar projects in the past and is a
<br /> quali�ed contractor. Based o� the bids received, staff recammends award of the
<br /> contract to Robert A. Bo#hman, Inc.
<br /> ALTERNATIVE5
<br /> Council may choose nofi to award the contract and direct staff to rebid this project.
<br /> FISCAL IMPACT
<br /> Funds far the turf conversion work of this project have been previously appropriated as
<br /> Water Bond Projects Fund — Recycled Wafer System Development which has an
<br /> available balance of $894,135.00 for the turf replacement prograrn. Funds for
