Such maintenance shall include, but is not limited to <br />repairs to all path surfaces, replacement of any plant materials deposited within the <br />access areas, removal of any encroachments into the access areas, and assuring that <br />the public access signs remain in place and visible. Within 30 days after notification <br />by staff, the permittees shall correct any maintenance deficiency noted in a staff <br />inspection of the site. <br /> <br />13. Assignment. The permittees shall transfer maintenance responsibility to a public <br />agency or another party acceptable to the Commission at such time as the property' <br />transfers to a new party in interest but on! y provided that the transferee agrees in <br />writing, acceptable to counsel for the Commission, to be bound by all terms and <br />conditions of this amended permit. Upon public dedication, conveyance, easement <br />or deed being provided to the City of Redwood City that expressly transfers <br />maintenance responsibilities, the co-permittee shall be deemed to have transferred <br />and assigned all responsibilities under this amended permit with respect to that <br />portion of the project or improvements included therein. <br /> <br />:g... C. In-kind Repairs. Maintenance and Replacement of Authorized Facilities. The permittees <br />are authorized to undertake routine, minor repairs, grading, and excavation of authorized <br />facilities such as repairing levee road surfaces, adding small amounts of fill to restore design <br />elevations and dimensions, minor grading within seasonal wetlands to promote vegetative <br />growth or ponding, etc., as long as such repairs, reconstruction and replacement do not <br />adversely impact existing wetlands or adjacent upland vegetation, the general public, or public <br />access facilities authorized under the conditions of this amended permit. Any in-kind repairs <br />and maintenance of the levee shall only use construction material approved for use in San <br />Francisco Bay. Construction shall only occur during current approved months during the year <br />to avoid potential impacts to fish and wildlife. BCDC staff should be contacted to confirm <br />current restrictions. <br /> <br />In the event that proposed routine, minor repairs, grading, and excavation of authorized' <br />facilities could impact wetlands or adjacent upland vegetation, the general public, or public <br />access facilities authorized under conditions of this amended permit, the permittees shall <br />transmit a letter to the Executive Director briefly describing the type and extent of work to be <br />performed under this amended permit for the coming year with a projected schedule and an <br />estimate of the cost of the proposed improvements at least three months prior to the <br />commencement of any maintenance work. If the Executive Director determines that the work <br />proposed may have an adverse impact on wetland resources or public access facilities, the <br />permittees shall be notified that such work is not authorized by this amended permit. The <br />permittees may then seek separate authorization of such work, either thr,ough amendment of <br />this amended permit or by applying for a new permit. <br /> <br />D. Work Within and Adiacent to Wetland Access <br /> <br />1. Marsh Restoration. The permittee shall restore the approximately 1,742-square-foot <br />marsh area where fill will be placed pursuant to Amendment No. Six to restore the <br />levee's integrity. After fill has been placed, the filled area shall be planted with <br />appropriate local and native marsh vegetation in accord with a plan approved by or <br />on behalf of the Commission pursuant to Special Condition II-A.
