SIX <br />(Exclusive of Amendment No. Four) <br />City of Redwood City and <br />Keech Properties, LLC <br />Page 14 <br /> <br />1. California Clapper Rail <br /> <br />a. Construction activities shall occur during the months of September through <br />Tanuary 31 st, the non-breeding season of the endangered California clapper rail; <br /> <br />b. If any work will be performed during the clapper rail breeding season (February <br />1 through August 31), the permittee shall conduct weekly call counts during the <br />rail courting period, from T anuary to April 15 coordinating the surveys with the <br />u.s. Fish and Wildlife Service, and generally following the protocols outlined in <br />the USFWS Biological Opinion; <br /> <br />c. A 700-foot-wide buffer shall be maintained at active clapper rail nests and be <br />monitored by a qualified biologist; and <br /> <br />d. All activity near the buffer area shall be evaluated by the field biologist in an <br />effort to eliminate any possible disturbance of adult or juvenile birds <br />(Amendment No. Six). <br /> <br />2. Salt Marsh Harvest Mouse. Prior to the start of construction and during construction~ <br />a Service-approved biologist, with previous salt marsh harvest mouse experience, <br />shall: <br /> <br />a. Be on-site to conduct a preconstruction survey; <br /> <br />b. Be present during the installation of temporary exclusion fencing around the <br />defined work area after vegetation removal; <br /> <br />c. Be present prior to the start of daily construction activities to inspect the harvest <br />mouse fence; and <br /> <br />d. Conduct site surveys during the initial ground disturbance and site preparation <br />to look for the mouse (Amendment No. Six). <br /> <br />G: F. Mitigating Construction Impacts. The permittees shall incorporate best management <br />practices during construction to minimize impacts on adjoining wildlife and public access areas. <br />Such management practices shall include imposing dust control requirements, assuring that <br />noise levels do not exceed the City of Redwood City's ordinances, and locating access and haul <br />roads so as to minimize impacts on existing vegetation. <br /> <br />F. G. Avoidance of Work at Extreme High Tides. Exterior levee construction activities will cease <br />along Segments III, IV and V during high tide series with tides of 6.8 NGVD or above as <br />predicted at the Golden Gate Bridge (Amendment No. One). These work restrictions apply from <br />two hours prior to the first peak of a predicted high tide to two hours past the last of the tide <br />peaks. <br /> <br />(;.;. H. Construction Operations. All construction operations shall be performed to prevent <br />construction materials from falling into the Bay. In the event that such material escapes or is <br />placed in an area subject to tidal action of the Bay, the permittees shall immediately retrieve and <br />remove such material at its expense. <br /> <br />fh 1. Debris Removal. All construction debris shall be removed to a location outside the juris- <br />diction of the Commission. In the event that any such material is placed in any area within the <br />Commission's jurisdiction, the permittees, their assigns, or successors in interest, or the owner <br />
