<br />PERMIT NO. 6-94 <br />(Issued on July 24, 1996, As <br />Amended Through March 4, 2010) <br />AMENDMENT NO. SIX <br />(Exclusive of Amendment No. Four) <br />City of Redwood City and <br />Keech Properties, LLC <br />Page 15 <br /> <br />of the improvements, shall remove such material, at their expense, within ten days after it has <br />been notified by the Executive Director of such placement. <br /> <br />I. 1 Creosote Treated Wood. No pilings or other wood structures that have been pressure <br />treated with creosote shall be used in any area subject to tidal action or in lagoons draining to <br />the Bay as part of the project authorized herein. <br /> <br />K. Certification of Contractor Review. Prior to commencing any grading, demolition, or <br />construction, the general contractor or contractors in charge of that portion of the work shall <br />submit written certification that s/he has reviewed and understands the requirements of the <br />permit and the final BCDC-approved plans, particularly as they pertain to any public access or <br />open space required herein, or environmentally sensitive areas (Amendment No. Six). <br /> <br />J. Notice to Contractor. The pcrmittces shall provide a copy of this amendcd pcrmit to any <br />contractor or person T/:orl-Jng in concert 'with the permittces to carry out the actiT!ities <br />authorized hcrein and shall point out thc special conditions containcd hcrein. <br /> <br />K.. L. Recording. The permittees shall record this amended permit or a notice specifically <br />referring to this' amended permit on all parcels affected by this amended permit with San Mateo <br />County within 30 days after execution of the amended permit issued pursuant to this <br />authorization and shall, within 30 days after recordation, provide evidence of recordation to the <br />Commission. <br /> <br />III. Findings and Declarations <br /> <br />This amended authorization is given on the basis of the Commission's findings and <br />declarations that the work authorized herein is consistent with the McAteer-Petris Act, the San <br />Francisco Bay Plan (Bay Plan), the California Environmental Quality Act, and the Commission's <br />amended coastal zone management program for San Francisco Bay for the following reasons: <br /> <br />A. Background. The existing exterior levee was improved between 1945 and 1962, and has <br />remained relatively unchanged since. The elevation of the existing levee top in the areas to be <br />improved pursuant to this amended permit is approximately 7.5 to 8.5 feet National Geodetic <br />Vertical Datum (NGVD), and the levee has an average width of 15 feet at the top and 50 feet at <br />the toe. The bayside of the levee is generally bordered by tidal salt marsh, a variety of native <br />and non-native grasses, and shrubs common to the upland transitional zone of San Francisco <br />Bay marshes. At the time, this amended permit was originally issued, the entire perimeter levee <br />is was open and used for public access, with portions of the levee trail paved to facilitate public <br />access; on the interior of the levee, the land uses included residential and commercial <br />development, a sewage treatment plant, radio facilities, seasonal wetlands, borrow ditches and <br />salt pannes. <br /> <br />In BCDC Permit Nos. 20-66 and 27-66, the Commission authorized levee improvements <br />and required public access on levees that are the subject of this authorization. In addition, as <br />part of a 1974 title settlement between the California State Lands Commission and Redwood <br />Shores' (the original co-permittee) predecessor, the State Lands Commission obtained fee title or <br />easements to the levee which was the subject of the original permit for the express purpose of <br />providing public access. Though there were few public access signs and portions of the levee <br />are that remained unimproved and poorly signed, the levee top was used by walkers, joggers, <br />and bike riders. <br />
