<br />PERMIT NO. 6-94 <br />(Issued on July 24, 1996, As <br />Amended Through March 4, 2010) <br />AMENDMENT NO. SIX <br />(Exclusive of Amendment No. Four) <br />City of Redwood City and <br />Keech Properties, LLC <br />Page 23 <br /> <br />authorized structure. In this amended permit, public access restrictions and <br />dedications will occur by a date certain, not with the construction of the levee <br />improvements which are likely to be completed first. However, public access on the <br />perimeter levees will continue until all of the alternative inland access areas and <br />improvements have been guaranteed and constructed. Because the interim access on <br />the perimeter levee is more desirable than the alternative inland access that will <br />eventually be provided to close portions of the perimeter levee access pursuant to <br />USFWS recommendations, and because, as conditioned, areas needed to complete <br />the alternative inland access trail and associated improvements are to be guaranteed <br />and the required improvements constructed prior to occupancy, the Commission <br />finds that the scheduling of completing public access improvements minimizes, <br />disruption of the public's use of the Bayfront and adequately ensures that the <br />alternative public access will be dedicated or otherwise restricted and constructed in <br />conjunction with the closure of access on the levee. <br /> <br />E. Amendment No. One. Amendment No. One authorized modifications to the original <br />permit to ensure that the project will be consistent with the requirements of the u.s. Fish and <br />Wildlife Service's Biological Opinion, including outlining seasonal restrictions for project <br />construction and altering some public access improvements. <br /> <br />F. Amendment Nos. Two and Three. Amendment No. One authorized a time extension for <br />completing levee improvements. Amendment No. Three authorized: (1) placing fill on levee <br />segment III to raise levee elevation and thus improve flood protection; (2) placing fill on levee <br />segment II to level the public access connection between levee segments II and III and repaving <br />this 300-foot-Iong portion of the levee; and (3) maintaining access to the observation deck by <br />creating a gradual slope for handicapped accessibility and constructing timber stairs. Work is <br />defined in Regulation Section 10601(b )(5) as "routine repairs, reconstruction, replacement, <br />removal, and maintenance that do not involve any substantial enlargement or any substantial <br />change in uses" within the 100-foot shoreline band and thus, the project is a non-permit <br />pursuant to Regulation Section 10822. Please note that Amendment No. Three to this permit <br />includes Ryland Homes as the co-permittee to the City of Redwood City because at that time <br />Ryland Homes accepted assignment of this permit from Redwood Shores on July 22, 1997. <br /> <br />G. Amendment No. Five. Amendment No. Five deletes a segment of the alternative inland <br />public access originally required adjacent to Shearwater Parkway. The access deleted will be <br />replaced with an approximately 1,700-foot-Iong path along Shearwater Parkway and a new <br />2,400-foot-Iong, 10-foot-wide path along the top of a levee pursuant to the requirements of <br />Commission Permit No. 5-07 issued on July 11, 2008, to Keech Properties, LLC, the new owners <br />of this portion of the alternative inland access. Because the project, as revised, will not diminish <br />the public access previously-required in this amended permit, the public access required herein <br />remains the maximum feasible consistent with the project and thus, is not a material change in <br />the originally-authorized project. Therefore, the Executive Director may issue an amendment to <br />a major permit pursuant to Regulation Section 10822. <br /> <br />H. Amendment No. Six. Amendment No. Six authorizes the placement of earth material <br />along an approximately 3.5-mile-Iong section of shoreline adjacent to the three sloughs at the <br />project site to raise the levee and provide protection for inland areas from tidal flooding.
