<br />PERMIT NO. 6-94 <br />(Issued on July 24, 1996, As <br />Amended Through March 4, 2010) <br />AMENDMENT NO. SIX <br />(Exclusive of Amendment No. Four) <br />City of Redwood City and <br />Keech Properties, LLC <br />Page 5 <br /> <br />2. Conformity with Final Approved Plans. All work, improvements, and uses shall <br />conform to the final approved plans. Prior to any use of the facilities authorized <br />herein, the appropriate design professional(s) of record shall certify in writing that, <br />through personal knowledge, the work covered by the authorization has been <br />performed in accordance with the approved design criteria and in substantial <br />conformance with the approved plans. No noticeable changes shall be made <br />thereafter to any final plans or to the exterior of any constructed structure, outside <br />fixture, lighting, landscaping, signs, landscaping, parking area, or shoreline <br />protection work without first obtaining written approval of the change(s) by or on <br />behalf of the Commission. <br /> <br />3. Discrepancies Between Approved Plans and Special Conditions. In case of any <br />discrepancy between final approved plans and Special Conditions of this authoriza- <br />tion or legal instruments approved pursuant to this authorization, the Special <br />Condition or the legal instrument shall prevail. The permittees are responsible for <br />assuring that all plans accurately and fully reflect the Special Conditions of this <br />authorization and any legal instruments submitted pursuant to this authorization. <br /> <br />4. Schedule. The plans shall include a schedule indicating when filling, grading, and <br />construction of public access improvements, and the development of ;:1djoining <br />parcels will occur. Construction of exterior levee segment IV, including any work <br />within 50 feet of outboard tidal marsh area, and the approximate 350-foot section of <br />segment VI, included in the project at the north end of the dredger channel, <br />including work on the inboard side of the exterior levee for approximately 30 feet <br />from any outboard tidal marsh areas, will occur between September 1 and February <br />1 to avoid the clapper rail breeding season. No seasonal restrictions on construction <br />apply to any other portions of the project (Amendment No. One). Interruptions, <br />closures, and disturbance of existing and public access areas shall be coordinated to <br />minimize disruption of the public's use of existing and proposed trails (see Special <br />Condition II-B-I0). Construction on levee segments I and VIII and in the area of the <br />connections between the existing and relocated interior levees and the exterior levee <br />are not subject to this restriction and may proceed throughout the year. <br /> <br />5. Responsibility for Flooding. The permittees shall be solely and entirely responsible <br />for any flooding that may occur as a result of constructing the project. <br /> <br />6. Additional Levee ImDrovements Authorized bv Amendment No. Six. The work <br />authorized in Amendment No. Six shall generally conform with the plans entitled <br />"Redwood Shores Levee Improvements," prepared by BKF Engineers, dated October <br />5, 2009. The work authorized in Amendment No. Six does not require further plan <br />review, unless the plans are modified. <br /> <br />B. Public Access <br /> <br />1. Area <br /> <br />a. Exterior Levee Access. Under the terms of this authorization, once the <br />alternative inland access areas, trails, and other related improvements have <br />been fully completed, the public's use of portions of the existing levee <br />
