Although access on the levees will be suspended, the <br />underlying easements and public access rights to the levee shall not be <br />extinguished. If the permittees wish to use the public access areas on the <br />exterior levees for uses other than levee maintenance, public access or wildlife <br />management purposes, the permittees must obtain prior written approval by <br />or on behalf of the Commission. <br /> <br />b. Alternative Inland Access. The alternative inland access areas, trails and related <br />improvements, with the exception of the public access trails located parallel to <br />Shearwater Parkway, as shown on Exhibit B, that have been deleted pursuant <br />to Amendment No. Five of this amended permit and replaced by comparable <br />access paths required pursuant to Commission Permit No. 5-07, shall be made <br />available for walking, bicycling, sitting, viewing, picnicking, and related <br />purposes. If the permittees wish to use the alternative inland public access <br />areas purposes for other than public access, they must obtain prior written <br />approval by or on behalf of the Commission. <br /> <br />2. Suspension of Existing Levee Access. Except for temporary closures of the existing <br />exterior levee access during levee construction (see Special Condition II-B-IO), all <br />exterior levees shall remain open to the public until the alternative inland access <br />areas, trail route, and other related improvements have been permanently <br />guaranteed and fully completed. <br /> <br />3. Review of Public Access. Every three years, beginning July 1, 1999, the permittees <br />shall prepare, in coordination with the USFWS and the California Department of <br />Fish and Game, a brief report describing: (a) the endangered species status of the <br />California Clapper Rail and the Salt Marsh Harvest Mouse (Le., whether either <br />species have been delisted); (b) estimates of population size of these two endangered <br />species in the tidal marshes adjoining the exterior levees; (c) the success of efforts to <br />control primary predators of the two endangered species, particularly the red fox; <br />(d) proposed or foreseeable development in the remaining undeveloped parcels at <br />the tip of the Redwood Shores peninsula (particularly Area H, the "radio parcels", <br />and the undeveloped lands around the sewage treatment plant); (e) proposed or <br />foreseeable modifications to the development proposed within parcels 1 and 2 of the <br />Lido parcel or the sewage treatment plant; and (f) modifications to the Endangered <br />Species Act (including changes which substantially reduce the USFWS mandate <br />under said Act) that might affect the public access restrictions on the exterior levees. <br />Changes in any of the above may trigger a Commission review of the public access <br />restrictions after appropriate review and coordination with the State Lands <br />Commission and resource agencies. Such review may lead to a revocation of access <br />restrictions on the exterior levee, or additional or modified public access trails and <br />areas along an inland route in connection with those changed conditions. The <br />Commission reserves the right to revoke or otherwise modify the public access <br />restrictions provided herein on the exterior levee, or propose changes to the <br />
