05/24/2010 <br />(h) Based on the Engineer's Report, the public areas to be maintained do not <br />benefit the public generally but are of sole benefit to the properties in the District. <br />(i) The special benefit assessments specified herein and in the Reports are <br />proposed to be levied and collected annually upon the last equalized, secured and <br />utility tax rolls upon which ad valorem property taxes are collected, said assessments <br />shall be in addition to all of said ad valorem property taxes, and shall be collected <br />together therewith, and not separate therefrom, and enforced in the same manner and <br />by the same persons and at the same time and with the same penalties and interest as <br />are said ad valorem property taxes; and all laws applicable to the collection and <br />enforcement of said ad valorem property taxes shall be applicable to said special <br />benefit assessments levied, and the assessed lot or parcel of property, if sold for taxes, <br />shall be subject to redemption in the same manner as such real property is redeemed <br />from the sale for ad valorem property taxes, and if not redeemed, shall in like manner <br />pass to the purchaser. <br />2. In consideration of the foregoing findings and determinations, this Council <br />hereby orders, and declares as follows: <br />(a) The Reports are hereby approved, subject to such amendment or <br />modification thereto as may occur by reason of the election and the protest hearing <br />hereinafter ordered. <br />(b) A property owners election is hereby called upon the question of approval <br />of the levy of assessments for fiscal year July 1, 2010 - June 30, 2011, and continuing <br />through fiscal year July 1, 2014 — June 30, 2015, subject to a maximum cumulative <br />assessment equal to the sum total of the projected budgets for such 5 -year period and <br />#15023 <br />Muff #507 <br />
