Page 49 <br />ATfACHMENJ L(' <br /> <br /> <br />April 20, 2010 <br /> <br />SUBJECT <br />Initial Study/Negative Declaration and Zoning Text Amendment for the Residential <br />Duplex (R-2) Zoning District. <br /> <br />ReCOMMENDATION <br />1. Adopt the Negative Declaration (ND) and the Initial Study (IS) for the evaluation of <br />the proposed Zoning Text Amendment with the following findings: <br />· The Initial Study/ Negative Declaration have been completed in compliance with <br />CEQA; <br />· That the Planning Commission has considered the Initial Study/Negative <br />Declaration, along with comments received during the public review process, and <br />has determined that, based on the whole record before it, there is no substantial <br />evidence that the project will have a significant effect on the environment; and <br />· That the Negative Declaration reffects the City's independent judgment and <br />analysis. <br /> <br />2. Make a recommendation to the City Council to approve the proposed Zoning Text <br />Amendment. <br /> <br />BACKGROUND <br />The City proposes to amend the text of Article 6 - R-2 - (Residential Duplex) District of <br />the Zoning Ordinance to establish residential development lot area standards for lots <br />larger than 10,000 square feet. Pursuant to the California Environmental Quality Act <br />(CEQA), staff prepared an Environmental Assessment. The Environmental Assessment <br />includes the preparation of an Initial Study and Negative Declaration (IS/NO) for this <br />project which describes the proposed Zoning Text Amendment, presents the findings, <br />and states the reasons why the staff has concluded that there will be no significant <br />impact on the environment as a result of the text amendment. A completed Initial Study <br />is attached to the Negative Declaration to support the determination of no significant <br />impact (Attachment 1). <br /> <br />The current R-2 section of the Zoning Ordinance does not specify how to determine the <br />minimum lot area for more than three units in the R-2 Zoning District for properties <br />greater than 10,000 square feet in size. The proposed Zoning Text Amendment will <br />remedy this condition and explicitly state which increment will be most appropriate for <br />this zoning district. The three proposed increments are: <br /> <br />· 2,500 square feet per additional unit beyond 10,000 square feet <br />· 3,333 square feet per additional unit beyond 10,000 square feet <br />· 5,000 square feet per additional unit beyond 10,000 square feet <br />
