Section 3.'130. Nonconforming Si~lns.. Any sign which becomes nonconforming as a <br />result of the provisions of this Article shall be considered to be an illegal sign after the <br />amortization period provided in subsection (d) below has expired and conformance has <br />not been accomplished. The City shall order the sign to be abated by the property <br />owner and/or person responsible for its installation and/or maintenance. The use, <br />routine maintenance and repair of any sign that was legally installed but does not <br />conform to the requirements of this Article may be continued during the amortization <br />period subject to the following conditions: <br /> <br /> a. Relocation and Alteration. No nonconforming sign shall be moved; altered <br /> by changing copy or enlarged in size unless such relocation, alteration or <br /> enlargement is required by law or brings the sign into conformance with the <br /> provisions of this Article. <br /> <br /> b. Restoration of Damaged Signs. Whenever fifty percent (50%) or less of a <br /> non-nonconforming sign is destroyed by fire or other calamity, the sign may <br /> be restored to its non-conforming condition and the use, routine maintenance <br /> and repair of the sign may be continued for the remainder of the amortization <br /> period provided in subsection (d) below. Any nonconforming sign that is <br /> destroyed by more than fifty percent (50%) shall not be restored unless it is <br /> brought into compliance with the provisions of this Article. The extent of <br /> damage to any sign shall be based upon the ratio of the estimated cost of <br /> restoring the sign to its condition prior to the damage to the estimated cost of <br /> replacing the entire sign with an identical sign. Cost estimates for this <br /> purpose shall be submitted to the owner of the sign for review approval by <br /> the City prior to commencement of any work to restore a nonconforming sign <br /> that has been damaged. <br /> <br /> c. Building Facade Modifications. If a building permit is issued for major <br /> modifications to the exterior of a building facade, as determined by the City, <br /> any nonconforming building signs on the fa(~ade shall be brought into full <br /> conformance with the provisions of this Article prior to final inspection of the <br /> building fa(;ade modifications, or within the amortization period provided in <br /> subsection (d) below, whichever occurs first, <br /> <br /> d, Amortization of Nonconforming Signs.
