dates of December 9 and December 16 on the subject of upcoming meetings for the
Cinema/Retail project. He further stated that City Attorney Yamamoto stated that the
intent of the letter was for the Council to act on this subject that night of December 9.
Mr. Luca stated that he wanted to go on record that he is pursuing the matter with
legal counsel. He urged Mayor Claire to conduct a meeting where all are recognized
by the Mayor in democratic form and equality. He stated that the Mayor does not allow
for rebuttal from the presenter to comments made by Council or others.

Mr. Luca stated that on December 9 he witnessed during the recess that the group
that gathered to respond to the alleged discrepancies in Mr. Bygdnes' report included
the developer. He stated that the cost remains what Mr. Bygdnes stated which is
$49,450,000.00, a figure directly received from the DDA summary.

Mr. Luca stated that he would like to question Council Member Pierce about what her
husband does presently as an occupation or employment. He requested a response
back if possible.

George Galvis, speaking for himself only, strongly encouraged the City Council to be
forthcoming with police abuse in Redwood City. He stated that tradition has been that
it has been politically unprofitable to take any strong action against police abuse. He
stated his hope that the Council takes the opportunity to take action to begin a hearing
process that effectively addresses the issue of police abuse and the needs and pain
of the family.

Janet Borgens stated that as the last meeting of the year, she wanted to express the
great amount of respect for the Council positions. The decisions are not always what
the people want; and emotions, feelings and newspaper articles have an impact on
the community. She thanked the Council and staff, acknowledging their difficult
decisions and assured the audience that the Council will do the right thing.

John Anagnostou encouraged the City to appoint a person to be working on the
Downtown parking plan now that difficult decisions were made. This would allow for
cooperation between the City, property owners and the Downtown Business group.

City Manager Everett stated to Council that sometime in latter January, Downtown
Manager Moeller would be bringing to Council as a discussion item, the Downtown
parking plan for input.

Robert Escobedo stated his brother was Rick Escobedo who died in the custody of
the Police Department. He stated that comments he heard of preconceived issues are
issues of which his family has tried to get answers from the Police Department. His
question is if the Police Department states that nothing wrong has occurred, why the
officers are not speaking to the District Attorney or Coroner. He urged the Council to

SPECIAL CITY COUNCIL MEETING, DECEMBER 16, 2002
MINUTES PAGE 2
MINUTES Book No. 59
Page No. 341
