Z Arab <br />of the grievance until the Association has received a copy of the grievance and <br />the proposed resolution and has been given the opportunity to file a response. <br />Upon request of the grievant, the grievant may be represented at any stage of the <br />grievance procedure by a representative of the Association. <br />15.2.7 This grievance procedure shall be the sole and exclusive procedure for <br />processing objections or challenges to punitive disciplinary actions and shall <br />satisfy all administrative appeal rights and protections afforded by the Public <br />Safety Officers Procedural Bill of Rights Act, Government Code Sections 3300, <br />et seq. <br />15.3 Procedure <br />Grievances will be processed in accordance with the following procedures: <br />15.3.1 Level I - Informal Resolution <br />153.1.1 Any unit member who believes he /she has a grievance which is an <br />alleged violation of the specific provisions of this MOU shall present <br />the grievance orally to the immediate supervisor within ten (10) days <br />after the grievant knew, or reasonably should have known, of the <br />circumstances which form the basis for the grievance. Failure to do so <br />will render the grievance null and void. The immediate supervisor <br />shall hold discussions and attempt to resolve the matter within ten (10) <br />days after the presentation of the grievance. It is the intent of this <br />informal meeting that at least one personal conference be held between <br />the aggrieved employee and the immediate supervisor. <br />15.3.1.2 Any unit member who believes he /she has a grievance which is an <br />objection or challenge to any punitive disciplinary action shall present <br />the grievance orally to the Captain within ten (10) days after the <br />grievant knew, or reasonably should have known, of the circumstances <br />which form the basis for the grievance. Failure to do so will render the <br />grievance null and void. The Captain shall hold discussions and <br />attempt to resolve the matter within ten (10) days after the presentation <br />of the grievance. It is the intent of this informal meeting that at least <br />one personal conference be held between the aggrieved employee and <br />the Captain. <br />15.3.2 Level II - Formal Written Grievance <br />15.3.2.1 If the grievance is not settled during the informal conference and the <br />grievant wishes to press the matter, the grievant shall present the <br />grievance in writing on the appropriate form to the Chief of Police <br />within ten (10) days after the oral decision by the immediate <br />supervisor. The written information shall include: (a) A descnption <br />of the specific grounds of the grievance, including names, dates, and <br />places necessary for a complete understanding of the grievance; (b) A <br />listing of the provisions of this MOU which are alleged to have been <br />25 <br />
