X24.34 <br />violated; (c) A listing of the reasons why the immediate supervisor's <br />proposed resolution of the problem is unacceptable; and (d) A listing <br />of specific actions requested of the City which will remedy the <br />grievance. <br />15.3.2.2 The Chief of Police shall communicate the decision to the grievant in <br />writing within ten (10) days after receiving the grievance. If the Chief <br />of Police does not respond within the time limits, the grievant may <br />appeal to the next level. <br />15.3.23 Within the above time limits either party may request a personal <br />conference. <br />15.3.2.4 Prior to determining the level of discipline to be taken on alleged <br />violations of City or Department rules and/or regulations, the Chief or <br />his designee will: <br />Ascertain if the represented employee wishes the Association to <br />intervene on their behalf prior to the decision being made by the <br />Chief as to level of discipline. <br />2. In those cases where intervention is not desired, the Chiefs <br />decision will be made without Association intervention. Denial <br />of Association involvement at this level does not affect any other <br />part of the grievance procedure contained in this MOU. <br />3. When intervention is desired, the Chief will contact the President <br />or their designee to schedule a meeting where the representative <br />will be granted access to the investigative file. This access will <br />not include the right to copy any portion of the file in question. <br />Appropriate copies will be made available after the actual <br />discipline is determined. After being given a reasonable amount <br />of time to read the file, the Chief will listen to confidential, oral <br />input as it relates to the actual level of discipline to be taken. <br />Association involvement at this level, does not affect any other <br />part of the grievance procedure contained in this MOU. <br />4. The entire process from date of notification to the PSA, by the <br />Chief, will be no longer than 10 working days unless extended by <br />mutual agreement. <br />5. All communications between the Chief and the Association at <br />this level is advisory and confidential. <br />26 <br />
