<br />O.zt:S <br />Page 46 <br /> <br />ATTACHMENT 4 <br /> <br />PETITION AND WAIVER <br /> <br />REGARDING PROCEEDINGS UNDER <br />THE MELLO-ROOS COMMUNITY FACILITIES ACT OF 1982 <br /> <br />City Council of the City of Redwood City <br />1017 Middlefield Rd. <br />Redwood City, CA 94063 <br /> <br />Members of the City Council: <br /> <br />This is a petition to create a community facilities district and with respect to <br />related matters, under the provisions of Sections 53311 et seq. of the Government <br />Code of the State of California (the II Law") , and the undersigned hereby states as <br />follows: <br /> <br />1. Petitioner. This petition is submitted by R. C. Peninsula Park, LLC, a <br />Delaware limited liability company (the "Petitioner") as the sole owner of the parcels of <br />land identified by Assessor's Parcel numbers attached hereto as Exhibit B. By <br />submitting this petition the Petitioner warrants to the City of Redwood City (the "City") <br />that the Petitioner is the sole owner of fee title to such land and the person or persons <br />executing this Petition are authorized to execute this petition on behalf of the Petitioner. <br />Petitioner hereby certifies that there have been no persons residing within the proposed <br />boundaries of the CFD (defined below) for each of the ninety (90) days preceding the <br />date of this Petition and Waiver. <br /> <br />2. Proceedinas Reauested. Petitioner hereby requests that the City <br />Council of the City undertake proceedings under the Law to (a) create a community <br />facilities district to be designated "City of Redwood City Community Facilities District No. <br />2010-1 (One Marina)" (the "CFD"), (b) to authorize the levy of special taxes on the real <br />property in the CFD; and (c) to authorize special tax bonds for the CFD in an amount of <br />not to exceed $17,000,000. <br /> <br />3. Boundaries of the CFD. Petitioner hereby requests that the territory <br />within the boundaries of the CFD include the parcels of real property identified by <br />Assessor Parcel numbers listed below. <br /> <br />4. Puroose of the CFD. Petitioner hereby requests that the CFD be <br />created, the special taxes be levied and the bonds be issued to finance all or a portion <br />of the costs of the public improvements identified on Exhibit A hereto, and to finance the <br />costs of issuing the special tax bonds. <br /> <br />5. Election. Petitioner hereby requests that the special election to be held <br />under the Law to authorize the special taxes and the issuance of the bonds and to <br />establish an appropriations limit for the CFD be consolidated into a single election and <br />
