<br />(a) $1,000,000 for injury or death of anyone person and $1,000,000 for <br /> <br />anyone occurrence; <br /> <br />(b) Property damage insurance in the amount of $1,000,000 <br /> <br />A certificate or certificates evidencing the maintenance of the required <br /> <br />insurance or program of self-insurance shall be deposited with the City Clerk prior to <br /> <br />occupancy of the City Right-of-Way by Permittee. In addition to the aforesaid <br /> <br />certificates, Permittee shall file with the City Clerk endorsements: <br /> <br />(a) Precluding cancellation or reduction in coverage of insurance before <br /> <br />the expiration of 30 days after City shall have received notification <br /> <br />thereof by first class mail from the insurance carrier; <br /> <br />(b) Naming the City, its Council, officers, boards, commissions, agents and <br /> <br />employees as additional insureds; <br /> <br />(c) Providing standard cross liability provisions; <br /> <br />(d) Stating that the insurance afforded thereby to City, its Council, officers, <br /> <br />boards, commissions, agents and employees shall be primary <br /> <br />insurance to the full limits of the liability of the policy, and that if City, <br /> <br />its, Council, officers, boards, commissions, agents and employees <br /> <br />have other insurance against a loss covered by such a policy, such <br /> <br />other insurance shall be excess insurance only. <br /> <br />6. Abandonment. In the event that Permittee abandons or fails to use the City <br /> <br />Right-of-Way, or shall fail, neglect, or refuse to maintain the improvements and conduits <br /> <br />in a clean and good working condition, or to comply with any of the conditions herein <br /> <br />contained, or in the event that this permission shall be revoked, then all rights of <br /> <br />A TTY/AGR/201 0.042 <br />051110 <br /> <br />3 <br />
