<br />Permittee hereunder shall forthwith cease and terminate. Permittee agrees to be solely <br /> <br />responsible for all the costs associated with the safe abandonment of the underground <br /> <br />sanitary sewer force main system. <br /> <br />7. At the request of the City, Permittee shall remove at Permittee's expense, <br /> <br />any of Permittee's improvements and conduits that conflict with any City facilities the <br /> <br />City may install in the future. Permittee shall relocate improvements and conduits <br /> <br />within sixty (60) days of a notice from the City to Permittee delivered to the address <br /> <br />above. <br /> <br />8. Assignments. The permit and the privileges granted to Permittee hereunder <br /> <br />shall not be assigned by Permittee without the prior permission of City, evidenced by <br /> <br />motion of City's City Council, duly made and carried; provided, that no such assignment <br /> <br />shall be made which would allow or permit a use of the City Right-of-Way different than <br /> <br />Permittee's use thereof or for a private for-profit use. <br /> <br />9. Successors. The terms and conditions hereof shall be binding upon, and <br /> <br />the benefits hereof shall accrue to, the successors in interest of Permittee, its assigns, <br /> <br />transferees, heirs, or grantees, unless said successors, assigns, transferees, heirs, or <br /> <br />grantees are a private for-profit use. <br /> <br />10. Effective Date and Termination. This Permit becomes effective on the date <br /> <br />of the last signature ascribed hereto and shall Terminate four years from this effective <br /> <br />date. <br /> <br />11. Acceptance.
