Claire <br />Vice Mayor Jeff Ira <br />Redwood City Council Members <br />February 3, 2003 <br />Page 3 <br />There are a number of permitted uses in immediate proximity to the proposed <br />CosmoProf D store which serve narrow segments of the population. There is a police and <br />firemen's uniform store in the same block and a bridal store across the street. There are <br />street level offices at 2611 Broadway, the Anvil offices, and 2603 Broadway, the Bottom <br />Duvivier offices, which are not really retail at all and do not really intend to sell to the <br />general public. The requirement that the store be open to the "population at large" raised <br />by the Zoning Administrator is not found in the Code, but the principal of whether the <br />existing permitted uses cater to a small segment of the population or the population at <br />large is an issue that is inappropriately raised in the Zoning Administrator's decision. The <br />businesses in immediate proximity to the proposed CosmoProf0 store do not cater to the <br />general population or public as do Wal -mart and Cost Plus stores. Therefore, the issue as <br />to whether the general public is served by the existing businesses is clear - =with the. <br />exception of the restaurants, a substantial number of the businesses in the immediate <br />proximity of the proposed CosmoProfg store cater to small segments of the general <br />public. As a result, there seems to be no reason to exclude the CosmoProfm store on this <br />basis. <br />(3) The Zoning Administrator found that her decision was consistent with past <br />interpretations and applications related to the use of West Coast Beauty Supply ( "West <br />Coast "), whom it is alleged requested to -expand and locate elsewhere in.. the CBR- <br />However, when Innovations personnel made inquiry of Planning personnel as to what <br />documents were available to demonstrate the past interpretations or that a'request was <br />formally made by West Coast, Planning could not provide any documentation supporting <br />West Coast's original objections. Likewise, Innovations personnel requested that any <br />documentation of West Coast's original complaint regarding the opening of the <br />CosmoProf0 store be disclosed and shown to Innovations. No documentation was ever <br />provided concerning West Coast's original complaint made in August 2002 nor is it <br />available on the City's microfiche records. <br />Additionally, Peninsula Beauty Supply commenced business at 1043 El Camino <br />in the CBR in early 1994, after enactment of the Code in 1991. The subsequent <br />amendments to the Code would not affect or prevent the opening of a similar business. <br />Peninsula Beauty Supply sells some of the same beauty products as does CosmoProffl. <br />There are also beauty salons in the CBR, which sell the same beauty products, as does <br />CosmoProffl. The CBR is no stranger to the sale of beauty products, and CosmoProfg's <br />sale of beauty products is certainly consistent with these other permitted uses. <br />
