Claire <br />Vice Mayor Jeff Ira <br />Redwood City Council Members <br />February 3, 2003 <br />Page 4 <br />At the CUP hearing Innovations presented the Zoning Administrator with 135 <br />letters, which were from Redwood City residents requesting that the CosmoProf D store <br />be permitted to open. Planning provided Innovations with 2 letters from West Coast and <br />its Redwood City landlord and one from a theater manager objecting to the CosmoProfm) <br />opening. The Zoning Administrator made no comment in the Notice regarding the <br />widespread community support for the CosmoProft® opening. The law in the State of <br />California generally supports competition and discourages monopolistic practices. The <br />Zoning Administrator's decision appears to support the continuation of the West Coast <br />monopoly in Redwood City. . <br />Innovations requests that it be treated fairly and that special restrictions and <br />interpretations not be used to prevent it from doing business at the proposed location- <br />Innovations expended considerable time, effort and money on this store prior to the <br />- Planning Department's decision in August. A timeline of these events is as follows: <br />A building permit was issued.to,Randy Smith Construction, Inc. on July <br />10, 2002, for tenant improvements to the property located at 2652 Broadway (the <br />"Property"). A copy of the Building Permit is attached. An .employee of Randy, <br />Smith Construction, Inc., Robert Auld is the who pulled the permit for the <br />Property. Mr. Auld states in his written statement dated September, 29, 2002, <br />attached, that he was asked by someone at the counter "what kind of business it. <br />was ". Mr, Auld replied, "the business sold only to.licensed beauticians He told: <br />this to a Planning Department official, who seemed more interested in what the <br />office space in the back of the. store was to be used for. No one asked Mr. Auld <br />whether the business "sold retail'. Of interest is the fact that there is no space on <br />the building permit to be filled in concerning the use of the space. The Property <br />was last inspected by a City building inspector on July 26, 2002. Including rent, <br />Innovations has spent over $58,000 on this aspect of the project to date. <br />The original Business License Application to the City of Redwood City <br />was filed on or about June 27, 2002. On the Business License Application under <br />"description/type business" Innovations clearly stated `Beauty Supply Sales, <br />membership only ". Nothing could have been clearer as to the nature of the <br />business and the customer base served. On July 26, 2002, Sailesh Mehra approved <br />the application as part of the planning review function for Business ,License <br />Applications. A copy of the completed Business License Application is attached. <br />Innovations continued with the improvement work on the premises until the early <br />
