DES:yc:IO/9/69 ORIGINAL OCT 20 000 RES 0 L UTI 0 N ---------- N O. ~/37 RESOLUTION CONSENTING TO REVOCABLE WAIVER OF INSURANCE REQUIREMENTS PURSUANT TO LEASE WITH POLICE YOUTH CLUB OF REDWOOD CITY, CALIFORNIA, INC. WHEREAS, paragraph 11 of that certain lease agreement (hereinafter called "the Lease"), entitled "Lease Agreement - Portion of Community Park," by and between the City of Redwood City (hereinafter called "Lessor") and the Police Youth Club of Redwood City, California, Inc. (hereinafter called "Lessee") and made and entered on March 14, 1963, provides that said Lessee shall secure and maintain at all times during the term of the Lease certain public liability, property damage, and fire insurance; and WHEREAS, it has been requested that this Council waive the requirements of the aforementioned paragraph 11; and WHEREAS, the.publ~c interest and corivenience.'will :.be served by consenting to the waiver of the insurance requirements of the above mentioned paragraph 11, subject to certain conditions; NOW, THEREFORE; BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: 1. Consent is hereby granted to the Police Youth Club of Redwood City, California, Inc., to the waiver, and waiver is hereby made, of those certain insurance requirements set forth in paragraph 11 of the lease agreement to which said lease agreement and said paragraph 11 reference is hereby made for the full particulars thereof, subject to the following conditions: (a) This consent and waiver is revocable at the will, and subject to the full and absolute discretion, of the City of Redwood City, upon which such revocation the aforesaid Lessee shall immediately comply with the requirements of said paragraph 11.
