<br />The State Water Resources Control Board
<br />removed the Phase II Storm Water Permit item
<br />from consideration at its February 4, 2003 meeting
<br />in light of the recent federal Appeals Court decision
<br />in Environmental Defense Center v. United States
<br />Environmental Protection Agency. The State
<br />Board is awaiting guidance from the U.S. Environ-
<br />mental Protection Agency regarding compliance
<br />with the decision.
<br />In the meantime, the State Board has issued
<br />an update advising cities and others on how they
<br />should proceed in preparing a Phase II permit.
<br />Federal regulations require jurisdictions subject to
<br />the Phase II Permit to file a Notice of Intent to
<br />comply and submit a Storm Water Management
<br />Plan by March 10, 2003. These jurisdictions
<br />should thus closely review their compliance
<br />options. The most current information provided by
<br />the Board is available on the Board's website at
<br />www.swrcb.ca-gov/stormwtr.
<br />Approximately 110 cities will have to comply
<br />with the requirements of the Phase II Permit based
<br />upon one of more of the following criteria: location
<br />within an urbanized area, population density,
<br />historic population growth, discharge of storm
<br />water to a sensitive water body, and /or discharge
<br />of pollutants sufficient enough to impair an other-
<br />wise unregulated water body. Municipal jurisdic-
<br />tions must develop a Storm Water Management
<br />Plan (SWMP) containing six prescribed programs
<br />in an attempt to minimize the environmental
<br />impacts of storm water discharges.
