S7~9 <br /> <br />RESOLUTION RESCINDING RESOLUTION NO. 5705; ACCEPTING <br />PARTIAL PAYMENT OF SUMS DUE UNDER AGREEMENT BETWEEN <br />DUMBARTON FIRE PROTECTION DISTRICT AND CITY OF REDWOOD <br />CITY: AND, ESTABLISHING CONDITIONS FOR FURNISHING <br />FURTHER SERVICES UNDER SAID AGREEMENT <br /> <br />WHEREAS, the Council of the City of Redwood City, by <br /> <br />Resolution No. 5705, adopted May 29, 1968, cancelled and ter- <br /> <br />minated for cause that certain agreement by and between the <br /> <br />City of Redwood City (hereinafter called "City") and the <br /> <br />Dumbarton Fire Protection District (hereinafter called "Districtll) <br /> <br />entitled "Fire Protection Agreement" dated June 16, 1967, and <br /> <br />that certain supplement thereto entitled lISupplementary Fire <br /> <br />Protection Agreement" likewise dated June 16, 1967 (herein <br /> <br />collectively called lIagreementll): and <br /> <br />WHEREAS, subsequent to the adoption of Resolution No. 5705, <br /> <br />District has delivered to City the sum of fifty-two thousand <br /> <br />two hundred nineteen and 02/100 dollars ($52,219.02) in partial <br /> <br />payment of the total sum now due and owing under the agreement; <br /> <br />and <br /> <br />WHEREAS, City desires to rescind Resolution No. 5705 and <br /> <br />reinstate the contract, subject to certain conditions agreed <br /> <br />upon by District; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. That certain resolution of the Council of the City <br /> <br />of Redwood City, being Resolution No. 5705, adopted May 29, 1968, <br /> <br />and entitled lIResolution Cancelling and Terminating Agreement <br /> <br />between Dumbarton Fire Protection District and City of Redwood <br /> <br />City for Furnishing Fire Protection by City within said Fire <br /> <br />Protection District," is hereby rescinded, and the agreement <br />
