DES:d~k 1' 15/89 (003/26) <br /> -- DES:d 11~21/89R <br /> <br /> WHEREAS, Pilot proposes to receive and store petroleum <br />products mixed with water, to separate the water from the <br />petroleum products and thereafter to store and distribute the <br />purified petroleum from the premises leased to Pilot under the <br />Terminal Lease; and <br /> <br /> WHEREAS, the foregoing separation process generates <br />wastewater which requires treatment capacity in excess of that <br />ordinarily available; and <br /> <br /> WHERE~S, Pilot requires the use of a portion of the <br />Non-Grant Eligible Capacity allocated to the Port of Redwood City <br />pursuant to the Resolution for the treatment of such wastewater; <br />and <br /> <br /> WHEREAS, there has been presented to, and reviewed by, this <br />Board a lease agreement providing for the. use by Pilot of a <br />portion of said Non-Grant Eligible Capacity for such purposes; <br />and <br /> <br /> WHEREAS, pursuant to Resolution No. P-1281, adopted January <br />13, 1988 that certain agreement entitled "Lease Agreement - <br />Wastewater Treatment Capacity Rights" was entered into between <br />the City of Redwood City, a municipal corporation of the State of <br />California, acting by and through the Board of Port Commissioners <br />of the City of Redwood City as Lessor, and Redwood City Services <br />Corporation, a Delaware corporation, as Lessee, which Lease <br />Agreement is dated January 13, 1988; and <br /> <br /> WHEREAS, pursuant to Resolution No. P-1288, the parties to <br />the aforesaid Lease Agreement dated January 13, 1988 entered into <br />an amendment thereto (hereinafter, the "Redwood City Services <br /> <br /> 2 <br /> <br /> <br />
