DES:d~k 1' 15/89 (003/26) -- DES:d 11~21/89R WHEREAS, Pilot proposes to receive and store petroleum products mixed with water, to separate the water from the petroleum products and thereafter to store and distribute the purified petroleum from the premises leased to Pilot under the Terminal Lease; and WHEREAS, the foregoing separation process generates wastewater which requires treatment capacity in excess of that ordinarily available; and WHERE~S, Pilot requires the use of a portion of the Non-Grant Eligible Capacity allocated to the Port of Redwood City pursuant to the Resolution for the treatment of such wastewater; and WHEREAS, there has been presented to, and reviewed by, this Board a lease agreement providing for the. use by Pilot of a portion of said Non-Grant Eligible Capacity for such purposes; and WHEREAS, pursuant to Resolution No. P-1281, adopted January 13, 1988 that certain agreement entitled "Lease Agreement - Wastewater Treatment Capacity Rights" was entered into between the City of Redwood City, a municipal corporation of the State of California, acting by and through the Board of Port Commissioners of the City of Redwood City as Lessor, and Redwood City Services Corporation, a Delaware corporation, as Lessee, which Lease Agreement is dated January 13, 1988; and WHEREAS, pursuant to Resolution No. P-1288, the parties to the aforesaid Lease Agreement dated January 13, 1988 entered into an amendment thereto (hereinafter, the "Redwood City Services 2
