DES:dik 1~ 15/89 (003/26) <br />~ . -- DES:d 1~21/89R <br /> <br /> Capacity Lease" means the aforesaid lease dated January 13, 1988, <br /> as amended); and <br /> <br /> WHEREAS, the Redwood City Services Capacity Lease provides <br /> for use of the premises described in the Terminal Lease for a <br /> water/oil separation project, subject to Pilot's consent; and <br /> <br /> WHEREAS, a final environmental impact report ("EIR") <br /> entitled "Proposed Oil/Water Separation Facility" comprised of <br /> the draft EIR dated November 1988 and the responses to the <br /> comments thereto (Volume II) dated December 19, 1988, was <br /> approved by the South Bayside System Authority in connection with <br /> the above-described proposed project of Redwood City Services <br /> Corporation; and <br /> <br /> WHEREAS, there is no material difference between the project <br /> described in the EIR and the project propQsed to be conducted <br /> pursuant to the Lease Agreement approved hereinafter; and <br /> <br /> WHEREAS, this Board has reviewed said EIR and considered the <br /> information contained therein, notwithstanding that insofar as <br /> the project affects operations at the Port of Redwood City, the <br /> project is categorically exempt from the provisions of the <br /> California Environmental Quality Act ("CEQA"; Pub. Res. C. <br /> ~§21000 et seq.) in that it consists of the operation, repair and <br /> maintenance of existing facilities under Section 15301 of the <br /> <br /> State CEQA Guidelines (14 Cal. C. of Regs. 15000 et seq.); <br /> NOW, THEREFORE; <br /> <br /> BE IT RESOLVED BY THE BOARD OF PORT COMMISSIONERS OF THE <br /> CITY OF REDWOOD CITY, AS FOLLOWS: <br /> <br /> 3 <br /> <br /> <br />
